if a company does not submit a dac report to usis., and the company that you want to go to work for is trying to get it from your former employer who is out of spite withholding it , is there anything that you can do to get it? Is it your legal right to have it from that ex-employer. thanks for any replies

Are you asking for the previous employer to verify your former employment and they won't submit it? If you have pay stubs you can submit them for verification of employment, though it won't help the company hiring you about your past driving record, but a current DMV printout should help or even a W2. If you can't go in person, fax it to them and see if they'll accept that. I don't know if that helped you any, but I tried. It's unusual for a company to not submit to DAC if they have a bone to pick with you or you did something that pissed them off. This is interesting.

dldibble, are you sure that Prime is even subscribed to DAC (Hireright). I wouldnt think that a company would have to supply you with a copy of your DAC report, but you, or the employer that wants to hire you, can request one. The one you request would be free of charge like a credit report, I dont know if a prospective employer would have to pay or not. But if whoever you have worked for in the past has not belonged to DAC/Hireright then there would be nothing on there from them anyway. Lots of companies do real back round checks and I doubt DAC even comes into the picture.

Prime subscribes to Hireright, and will report your employment to them. Now, any carrier who deals with Hireright has no obligation to an employee to provide them with their DAC report. However, it does come under the Fair Credit Reporting Act (feature that, eh!) and like your credit report (as rockee posted) you are entitled to a free copy of your DAC report once a year through Hireright.

The new employer requested a copy, from Hireright, when pulling it up it was completely blank. They had never put anything on it I guess. I guess the best thing to do is give the new employer a w2 to show employment. If there was anything bad to put, Prime would of put it down cause they were peed off when I left.
