This is such a useful article. This should be more than a sticky, this and a few articles like it should be compiled as a "new trucker legal primer" and at the very least stickied on the new trucker advice section of this and every other trucking related website.

There are so many ways to get screwed in this industry, and so many details to attend to if one wants to succede. I don't know where I as a soon-to-be driver would be without resources like this.

Ideally, I think that it would be a great recruitment strategy for one of the unions maybe to compile this kind of advice into concise, readable guides to be physically printed and distributed free or at low cost at truck stops and such...

The info on a MVR is usually resricted ONLY to information relating to your driving record; tickets, accidents, ect. You can usually get one free at your local DMV.

A DAC record is different entirely. While it contains information of your driving history, it also MAY contain your credit history, criminal background and work related history; including information such as workers comp claims and reason for discharge from employment, even if these "histories" are not true.
There have been several cases recently, where a driver found someone else's CRIMINAL BACKGROUND History attached to their file at USIS, and for the most part; correcting these errors has proven difficult, if not impossible.
I discovered (last year) that USIS reported that I was ticketed in Arizona for "Operating a Motor Vehicle With-in 4 Hours of Consuming Alcohol", a TOTALLY frabricated claim. I WAS successful in removing this LIE from my DAC record, but not with-out threats of legal action.

Where do you get your DAC Report??

It is USIS' policy to send you a letter if a company has requested any background request on you. They are required to do so as it is a credit report that they get your background from. In this letter is instructions on how you can get a free copy and dispute instructions as well.

I am an Operations Manager who requests these all the time, and if a company is making a hiring decision on your MVR, the only way that can be fixed is to see your State's Division of Motor Vehicles/Driver's License Department. I have had drivers show me their MVR, and never in my 15 years seen an inaccurate report from USIS.

I agree on their MVR's accuracy, their employment history database is a different story, and it's not necessarily their fault - GIGO (garbage in garbage out)...

Just so you all know, I am working with an actual service that will fix the DAC reports for truckers. We are in negotiations now on how to go about all of it. He DOES have the service running and this guy knows what he is doing. I'll try and let you all know by this evening, thanks!

Hope this is the right place for this question, it is on driving records. I had two alcohol offenses 20 years ago. One was a DUI for sure, cant remember if the other was cassified as a DUI, as I was under age, but I know it was not a good thing. I have a CLEAN record for the past 5 years, yes, clean. No tickets or accidents of any kind. The 5 years before that I have a minor speeding ticket( 5mph or less over) and possibly one minor fender bender( it may fall into the previous 5 year period) that was not attributed to me(called a no fault) on account of black ice. Again, the next 5 year period has only minor speed and possibly that above mentioned accident. Most company web sites say you cant have DUI type offenses in the previous 5 yrs., but a few I am interested in later say never had two. Any help? Am I going to have to give up my trucking dream because of 20 year old mistakes that have not been repeated? Not even close? Thanks for any input.

If you are in school now I would start contacting companys and don't hold anything back about your past and see what they say.
