Dac report

    Hi there, any advice on the following would be very much appreciated.
    ====================================================

    My husband got fired from his company of 4 years due to excessive complaints. No warnings, no comments, just arrived on the yard while on way to shipper and called into the office. Had to pack there and then.

    We were a bit surprised at this. Who doesn't get call ins while driving down the road. It would have been nice for the company to have mentioned this to him sooner.

    Anyway, hubby starts looking for a new job, and gets turned down. Upon further investigation, we found his DAC contained 2 items that the company said they weren't going to put down.

    1) An "accident" that wasn't an accident a couple of years back. Car in front at intersection went to go, and then braked, hubby's truck bumped the back of the car. Hubby lets company know the situation. There was no damage, no report, no insurance, nothing raised from the driver, nothing. We didn't think to get something in writing at the time.
    Company noted on DAC the accident.

    2) A year back my hubby was training (gave me a break from the road) . One of his trainees made a comment about him having a gun on the truck. Then another trainee heard and made comments to the Safety guy at the time hubby was with Safety in the office (so there wouldn't have been an opportunity for hubby to sneak out, grab the alledged gun, hide it down his pants, and dispose of it in the garbage bin). So hubby said for them to go search his truck and they said "no, we don't want to search your truck". So we thought that was the end of it. A bit of light hearted banter. Well if only we weren't so stupid back then because the company put that on the DAC "alleged to have gun on truck".
    And to be clear here, we do not carry a gun on the truck, never have, never will.

    We are in the process of requesting a copy of the DAC.

    My question if anyone has any advice or something is:

    If there isn't any paperwork proof or proof at all, can we still put in for a disbute/rebuttal against the company? Or are we just wasting our time.

    I would vehemently challenge both entries, if the following applies;

    If there was never any documentation to either of these incidents that your husband is aware of, having been in evidence, then fight them tooth and nail.

    The accident that was not an accident will have to be supported with an accident report, or a signed piece of paper that your husband would have signed in ackowledgment of the accident, in the absense of a police report.

    The gun accusation is a strong issue, but only valid if the company had a policy in place at the time that prohibited a gun in the truck. Even if they did, there is no proof to the accusation whatsoever, and again, because the company cannot document the "accusation", fight it and demand it's removal from the report.

    Why do I get the feeling that the company in question is JB Hunt? This rings completely of the crap they do to drivers. Am I right?

    Make all of your challenges clear and polite, but stern at the same time. Demand the company prove both incidents or call for their complete removal from the report for being completely unfounded, without documentation to support them, and a form of blackballing tactics.

    Send all correspondence by certified mail, return receipt requested. Let USIS know that if this matter is not handled to the letter of the law, that you will file complaint with the FTC and consult an Attorney to force removal of this misleading and false information. And by golly...do it.

    Thanks for the reply TurboTrucker. Appreciate the advice. We will most definitely be doing our best to get this cleared.

    I am always amazed at how the truckers are treated and the lack of protection and rights they have against the companies who treat them like crap.

    the company is Wiley Sanders. And as "wonderful" as they have been about adding all this stuff on to the DAC, they did say hubby was welcome to come back in 6months.

    Yeah we see how that goes. Make it so he can't get another job out there, which guarantees them an experienced trucker in 6 months time. How convenient.

    Hi, All, I constantly get requests of where truckers can get their DAC Reports. Please click on the above link to find some info on Trucker DAC Reports, thanks!

    They do NOT make it easy to get your DAC Report and you have to jump through some hoops, BUT I would get one and make SURE you review it occasionally!

    They do NOT make it easy to get your DAC Report and you have to jump through some hoops, BUT I would get one and make SURE you review it occasionally!

    Good idea. It's a wonder Turbo didn't think of this. May I suggest posting this in the experienced truckers advice secton also?
