In other words, any amount of THC in the split is a positive assuming there is/was still THC systemically in his anatomy when the specimen was provided. A reasonable assumption with the information at hand would indicate that the split would also be positive under the circumstances.

But the key here is as he stated above that "I don't want to do weed anymore", and "I will not do weed anymore" which suggests he was still doing it at the time of testing and merely hoping that by using a lot of water he could come out negative. It may also be that all the water he drank prior to the test caused the test to come out diluted for specific gravity when the testing facility used the hygrometer/dip strip on the specimen as well as a low creatinine level. A diluted specimen is considered a positive/diluted under the rules however, and memory serve, there is/was an option for another test (or there used to be an option before I retired which may have changed) if a specimen was diluted and if the carrier so wished.

Either way, the S.A.P. route is his only option now as mandated in the rules and hope to find a company that has a second chance policy after he receives his CDL and the completion of the S.A.P. counseling and any potential recommendations by the S.A.P. for therapy as mandated under 382.503 and part 40, subpart O (40.281 through 40.313). This may also be a quite substantial amount money over and above the cost of obtaining his CDL as the company from whom he was attempting to receive his CDL also probably listed the positive on his USIS/DAC report.

I do however wish this gentleman success in finding suitable employment after the S.A.P. routine.
Hi psanderson- I have recieved your Private Message but i am unable to respond back since i dont have 50 post yet. I would like for you to send me the info you have about the drug classes. Also to clear something up about your comment of me still smoking during the time of the test, i would like to say thats incorrect because i was clean from smoking for 3 and a half weeks before the test, I believed i had naturally gotten rid of the THC and was o.k . Had i known i didnt wait long enough i wouldnt not have tested. I dont have any excuse's for why i smoked but i have MANY resons why i dont anymore!! Thank you again psanderson your advice and knowledge is greatly appreciated

I'm hoping even with this mistake ive made that things will get better and hopefully just be a friendly reminder what "smoking pot" could of cost me !!
one thing ive learnt now is SMOKING REEFER MIGHT MAKE YOU FEEL GOOD,BUT SOONER OR LATER IT WILL COST YOU MORE THEN JUST MONEY AND MUNCHIES!!! " Think about it "

P.S. Thank you also Cerberus:

PSanderson..Yeah i didnt bother having them check my second sample because i new if 1 was dirty then of course the second one would be dirty.
2 years ago the tuition at Western was right around 5 grand, so that $1000 is only a downpayment. Getting the CDL isn't the hurdle, it is finding someone that will hire you and going through the SAP process. Make sure you can find a job before you spend that kind of money getting your CDL.

Hi Leannamarie, I was up front an honest about the drug test to the gentlemen at the school, He claims when i get the class A and complete the 30 day SAP then getting on with a semi desent company shouldnt be a problem ex. Watkin shepard,Covenant ect. But, considering what i did "testing positive" i cant expect this to be a easy road to travel i just know i never want to go threw this again!! Thnx again!!

I'm no expert, but from what other people have said, it is not all that easy to find a job after completing the SAP. Maybe at one point when there was a true shortage of drivers, but when companies are refusing employment to people with 20 year old DUI's, I would think a fresh positive like that would make your life very, very difficult. There have been people here on this forum who have gone through the SAP process, do a search for what they have said.

Hi Leannamarie - Like i stated in my post i know this will be a long and hard road and i will probably never be able to work for a huge carrier company. But, i just got a call earlier from a local company that my best friend drives for and the gentlemen said he would like to be the first to offer me my "second chance" and give me a job driving for him ONCE i've completed the SAP. I honestly believe everyone deserves a second chance and heres mine Lesson learnt now im moving forward and will never, ever, ever get myself in that situation again.

Thanks to all for your comments and i will keep you all posted on my travels!!!

I know hind sight is 20\20 but WHY didnt you go to your local phamacy and purchase a few instant drug test and test yourself before you went. to make sure you were clean....I had a friend who was a daily user and when he quit it took 4 months for him to clean out naturally...and he never filled out an app untill he tested him self first to make sure he was clean just to avoid what your going thru now....

Hey there SBM, don't give up the dream if it means that much to you. I know of a lot of smaller companys that won't fault you for that one. Insurance companys of coarse are going to be nervous but if you persist and keep on the straight and narrow you'll have a future. Something to think about- I paid over 4 grand to go to school out of pocket and more than made the money back in the first year. I too chose to clean it up, I can tell you it's worth the effort.

i WAS a 20 yr "vet" of heavy usage. quit for 6 WEEKS before going to school.
body fat content has ALOT to do with the equation as it (THC) is stored in fat cells.
i am a tall skinny MOFO so no problems there LOL
I am glad that you like I did realize that "smokin out" isn't as FUN as you thought it was. i for one do not miss it one BIT like i thought i would. i enjoy my short term memory i got back!!
