Handling Accidents

    I was involved in an accident with an 18 wheeler, who I am unsure if he even was aware he struck me. The driver made a left turn from a center lane (which is not a turn lane) to enter an interstate entrance ramp. Unfortunately, I was in the left lane about to make the same turn legally when I noticed the semi making the turn, so I quickly stopped my vehicle, however while the semi completed his turn, the trailer ripped the front end off my vehicle, completely disabling it, and the driver kept driving. I had witnesses stay, providing all pertinent information, including the license plate number on the trailer and a hit and run report was taken by the local police department. My vehicle had to be towed from the scene.

    I called the trucking company and they took a report from me, but two days later - I am not getting any response back from them... other than they stated the driver told them he was never at the location where the accident occurred.

    I am not injured, thank goodness, and only want my car fixed and returned. Is there any information I can obtain from you guys to help. I do not want to get the driver in trouble, but all of us know striking a vehicle and leaving is not the proper way to handle things. IF by chance he had no knowledge of striking me but it is obvious this accident did occur, what is the proper protocol?

    OK, you filed the report with the local PD. And you called the trucking company. Both good moves on your part. Now, let your insurance company handle the rest of it.

    Thank you so much for your quick reply. Of course if I file with the insurance company I get a "claim" knock on my record and fork over a $500 deductible I do not currently have in my bank account. I have been very lucky in my 45 years of life to never been in an accident or have to file a claim.

    Do these type of accidents work out typically?

    Actually you really need to let your insurance company know about it. They will likely find out when it is time to renew your policy anyhow. A lot of them check DMV records. And they will flatly cancel your insurance if the find you have held out on them.

    Now from what you posted, it sounds like you were not the primary cause of the accident. I doubt that this will raise your insurance rate. You did not mention if you received a citation or not, but if you did not, then you shouldn't worry about it.

    You pay your insurance company to take care of problems. Let them.

    And there is always the option of calling a (oh how I hate to say this,) lawyer. (shudder)

    Oh, don't worry about getting the driver in trouble. YOU are not the one getting him in trouble, HE is. I suppose it is remotely possible that he did not know he hit you. But if that is the case, then he really shouldn't be driving a commercial vehicle.

    Until it happens to you you won't believe this but it is very possible for this accident to have happened and the driver never felt it.

    VERY POSSIBLE!!!!!!!!

    Here is what happened to me. Granted this is not a semi but with a semi being bigger its less likely to feel this.
    I'm driving a pickup pulling a 24' goose neck trailer on a 2 lane interstate. We are approaching a small construction site with warnings of the left lane closing began 2 miles ahead of the actual lane closure. A Honda Accord 4 door is hanging out in my left lane and even with the barrels beginning to close the lane and the large blinking arrow the driver of the accord stayed on my left, never moving past the front of the trailer. I do not know if this guy was that blind or what.
    Any way in order to avoid hitting the barrels he dives into the side of my trailer, hitting it about square with the tandem axles/tires area.
    He never stopped so I didn't either. Once the lanes opened up again he passed me. The side of his accord was caved way in. There is no possible way the driver and passenger didn't know what happened to them.
    They never stopped so I didn't either. Eventually they rolled on up the road and out of site never to be seen or heard of again.

    When I stopped and looked at the trailer the ONLY indication that any thing out of the ordinary had happened was a very small scuff on one of the tires.

    The point to this long post is that had I not glanced into the mirror at the exact second of impact I would have never known any thing happened!! I never felt any thing adverse with the vehicle. Nothing at all.
    The side of their car was caved way in. Both doors.
    I have no idea why in the world they never stopped.


    I've heard similar stories of a truck's tail swing hitting a car and the driver didn't feel it. Enough to believe that it does happen. I wouldn't have believed it without the above experience happening to me.

    No, I did not receive any tickets and according to the police report, the truck driver was listed as "inattentive" and "improper turn".

    Thanks for the heads up.

    Brickman - I too am unsure if he knew he hit me and I tend to give people the benefit of the doubt. However, apparently with him saying to his company that he was never in the area has me concerned.

    I never judge anyones profession, as they are all case specific. I am glad you guys put in your long hours and provide things to us daily that we all take for granted.

    But the point is Brick, that you were watching what was happening, and you DID know it.

    Thats not the point, the point is that I never felt it. And wouldn't have had any idea that any thing happened had I not just glanced in the mirror.
    The point is that its very possible to not feel some thing like that as it pertains to this thread.

    Well my point, is that when making a turn, you had best be keeping your eyes moving, and that includes where your trailer is going. Now if you are making a left turn, and something hits your trailer on the right, where it is a "blind side," I can see that you might not know it.

    Did the police get sworn statements from the witnesses?

    If so, request a copy and send them to your insurance company.
