k1221n, I'm not much for ratting out people myself, but when safety is concerned, there's definitely cause for concern. I'd report a drunk driver, if I knew for sure the driver was indeed drunk, so it's safe to assume I'd do the same for someone who is wasted.
But I'd first need to see it myself, first hand. To report someone to their employer based upon something they do on their own personal time (at home, no less) just doesn't seem right to me. Because you're not looking to ensure safety of the public from what could be a DUI, you're looking to "get even" with someone you happen to have as a bad neighbor.
I'm not saying I condone using, I'm saying, how do you know for sure it's being done on the job? Would you really want to put someone's livlihood in potential jeopardy without knowing for sure it's something job related?
However, if you are 100% sure that you are doing the right thing, a written and mailed letter carries more weight than a phone call.

Hazmat has nothing to do with it....all employed class A drivers are in a pool. My name was drawn this month at my one job, and at my other job the prior month. I am...therefore I pee.
The other type of testing is when there is reasonable suspicion...there has to be evidence of being under the influence...to be tested. No employer can say on Monday, I want Johnie to go for a random drug test because I think he might be using...Johnie's name has be drawn in order for the employer to send him for testing, or there has to be EVIDENCE of drug or alcohol use to send a driver for testing.
The third type is accident testing...if you are in MVA with your truck, you will be tested for drugs.
The other type of testing is post job offer testing, and testing while under treatment to determine if you can return to work...and testing for a period of a year or two on an unannounced basis, that is the up to the employer to decide.
So there are 5 drug testing scenarios that are permitted and/or required by law for class A drivers.
It is complicated, hence the 500 pages in the green book. -
He cannot be sent for a random drug test, unless his name is drawn from the pool, per FMSCA regulations. -
All you need to do is call 911 and report the erratic driver(s). -

I have a couple neighbors like that calls the police because they dont like the ideal of me parking my truck in front of my house. then they stand outside and wait to see if the cops make me move it well the laugh is on them there is nothing in the city ordnance that say I cant park it there
