OK, here's the scenario. This is a real situation that occurs near my home, and I'm sure at countless places around the country.

Two traffic lanes, undivided US highway in a semi-rural area. 65 MPH speed limit.

Cross road intersection. Through traffic on highway does not stop.

Third lane on right side is a right turn lane/acceleration lane, clearly marked as "Right Lane Turn Only". Several businesses are located along the side of the road, before and after the intersection.

I'm turning left, and have to stop to wait for oncoming traffic to clear.

You come up behind me in your rig. Do you:

    A. Come to a legal stop behind me, and then start again from a dead stop after I make my turn?

    B. Illegally pass me on the right side, using the turn/acceleration lane?

No doubt you gotta stop......if you tried taking that turn lane only you could smack somebody up real good, lose your license, go to jail, possibly even kill someone.

I stop for many reasons including the legal part. I also stop because the car that is tailgating me can't see around me and may in fact try to go to the right and cause an accident. I have had many close calls from idiots doing just that.

Legally, you should stop, but I could see a situation where I might go around on the right, for instance, 6 am Sunday morning, no ones up yet, I can see over your vehicle that there's no one coming out of the driveway and no cops in sight.

    Stop.
I had a friend who illegaly passed on the right at an intersection and was hit by a left turner coming from the other direction. Even though he was hit by the other driver, which usually makes that other driver at fault, he was determined to be at fault for illegally passing on the right.

Stop and wait, but keep an eye on your mirrors for people coming up behind you not paying attention!
