McElroy Truck Lines - Cuba, Al.

I got my cdl-a on 4-3-06.I went to an orientation with McElroy Truck Lines at their terminal in Pleasant Hill North Carolina on 4-10-06.I was told by the moderator Brent Roberson that I could be terminated from orientation at any time with or without reason and in turn I could choose to leave orientation at any time with or without reason. He said that this could be done because I wasn't OFFICIALLY hired until completion of orientation and successful completion of a final road test. I chose to leave orientation because the information I received from their recruiting department and the information I was getting from their instructors was to different to overlook.I was told by the instructors and the terminal manager that nothing could go on my dac report because I was never OFFICIALLY hired and was even urged to reapply at a later date if I chose to.It wasn't until I had applied at several other trucking companies that one company finally gave me a reason why they couldn't hire me,They said it was because McElroy had put a notation on my dac report saying that I quit under dispatch.I want to know if McElroy can get away with this BS and if there's anything I can do to fix my dac report? I got screwed before I even got started!!!

I'm sure that you meant "Quit during orientation"....right?

The first thing you need to do is to get a copy of your report, which you are allowed to do once per year, free of charge, and see what exactly was put on the report.

You will have to send BY MAIL, a LEGIBLE copy of your driver's license and Social Security card with your written request for a report. You will also have to state the reason why you are seeking a free copy of the report, and that reason is to verify information that have reason to think may be incorrect on the report.

Don't bother calling them. They will do nothing over the phone, and ALWAYS send ALL written correspondence by CERTIFIED mail, return receipt requested.

The law is clear on what can be entered into the report. First of all, if the report actually states that you "quit under dispatch", your challenge is easy. You never worked for them and therefore were not "dispatched" by any definition of the word, and you demand the removal of all reference by this Motor Carrier.

Now, if it reads that you quit during orientation, it gets a little trickier.

Did you by chance sign ANYTHING at all for the company, that acknowledged that you were on their premises? More specifically, did you sign a receipt for them that may have given them a showing that you received transportation, food, or lodging while you were in North Carolina?

If you received any funds in the form of wages or reimbursement, and signed for them in any manner, you have no legal challenge to the entry, and you're not going to be likely successful in challenging the report.

In your case, here's what I would do. I would write a brief, but stern letter to USIS/DAC Services, once you know what is on the report, and make it perfectly clear that you did not ever work for McElroy Truck Lines, that you were never extended an offer of employment by them, and that you were not paid wages in the form of compensation for any work performed for them, and respectfully request that the entry be completely removed from your file. Use the EXACT language above as well.

It gives you a 50/50 chance, and it will let them know that you KNOW what the rules are for an entry to be legally allowed to stand, and they may well pull it. Also request that an amended report be sent to you upon disposition of their findings.

If that fails, the best you will be able to do, is to offer a statement to be put in your report that will outline the reason why you declined to continue on with the orientation. Offering that the terms of the job were misrepresented by a recruiter will be about the best retort you will be able to accomplish.

It's rather sad, but these companies out here know that recruiters lie to drivers all the time, and yet they will look at a report that states that a driver quit during orientation, as if it were on fire.

Please let us know how this turns out. I'm rooting for you...

By the way, what were those points that made you decide to leave McElroy? I have a neighbor that has worked for them for several years, and while I've never really asked him about the company, he seems to like what he does.

Someone who reads this thread, that may be considering them as a prospective employer may be interested in a heads-up as to what went wrong for you.

Here we go again, ladies and gentlemen

Here we go again. Yet another driver has again spoken about the reason why DAC should be scrapped--DAC gives too much opportunity for liars at trucking companies to abuse their drivers.

This driver has been burned for 'quitting under dispatch' before he'd even been assigned a truck.

It's obvious what the insiders at the company are doing here. They want to take away this driver's choice to go somewhere else and drive for a competitor. DAC allows them to do this. They know if they burn his DAC and then wait long enough, he'll come crawlin' back wanting to finish orientation and drive for 'em for a while.

On your knees, knave!

Truckers BEWARE Makes promises they can't keep. Uses the new truckers to make there money but you do not get any, they don't pay for all the miles you RUN!!! MAJOR RIP OFF COMPANY, TRUCKERS DO YOURSELF A FAVOR STAY AWAY!!!

BrenR, how much hometime are you getting at McElroy? Their recruiter visited our school early on during the course and hometime was a big selling point for the company. My application with them was denied pretty quickly, I think because of my age. Someone had already told me that flatbedding is a young man's game.

I'd be really interested in some details on whatever the problem was. I have an application in with them. BTW, the recruiter claimed they don't have an upper age limit on hiring although they won't take anyone younger than 24.

Decent opinion about McElroy Truck Lines

I worked for McElroy for 6 months. I was laid off for no frieght where I live, western Pa. If you live in the south east and want to run flatbed, I would recommend this company. If I remember right there starting pay was 38 cents for new drivers with no experience, I averaged about 2,500 miles a week, give or take. Alot of their drivers' complaints was the main company policy (McElroy Truck Lines = MTL) MTL stands for Must Tarp Load. and they don't pay any extra for tarping. Even if customer insists not to be tarped, it must be tarped anyways, dispatch will tell ya to stop a cpl miles short of customer and tarp/un-tarp load. I know the dispatcher out of Pleasant Hill, N.C. wasn't the greatest to work with, but still communicating with some of their drivers today, They aren't having any problems with their dispatchers.

Cpl things I forgot about

Some more things about McElroy Truck Lines. If you want weekends home.. they are a good company for that. They gurantee you home every weekend. In case some ppl don't know, in the flat bed industry, or should I say regional-- Weekend.. usually means getting home friday evening/ early saturday morning, and being home till Sunday ... afternoon. McElroy's policy is that you will be home for a 34 hr restart on the weekend, if not you are paid an additional $100 In my 6 months I worked there, it happened twice.
They was real big on the driver arriving at the consignee the evening b4, delivering early morning and ready for the next load assignment with a full 11 hours to drive.

McElroy truckline

Hello, I have a question for you. I see where you have worked at McElroy for 6 months, but you have been actually driving for a year. Why did you leave McElroy if you don't my me asking. They claim to be a family oriented company with Christian morals and ethics. Is this so? Or is it needed to be taken for face value? Any further insight on this comapny would be appreciated. Thanks for info. Good Day.
