For Turbo Trucker
Sure would appreciate a PM and tell me who these companys are you spoke about in your statement below.

"A couple of carriers came to see this, and did something about it. Without sounding like I am endorsing them, I'll not name them. They created a department to field these types of complaints, and solved problems by putting the drivers in touch with the appropriate people that COULD solve the problem. It worked too. One carrier slashed their turnover rates in half, and in less than a year."
Thanks

Swift Transportation Company, Inc. - Phoenix, Az.
I started with Swift about 9 months ago and trained through their facility in Richmond with a company financed loan of $3,900. The program is they deduct $300 a month from your pay for the first year to pay for the school loan. Swift has turned out to be a the worst experience ever and I've taken a job with Knight. Swift has stated in their school loan contract that the remainder of the loan (about 1/2 at this point) has to be paid immediately or they will have my CDL revoked. Can they do this? Also, the truck I was given was out of the Eden terminal and two weeks ago that terminal was closed and they transferred me to the Harrisburg PA terminal, which is about 8 hours from where I live. My car is in Eden. Do I have to return the truck to Harrisburg or where I originally picked it up? Swift is also threatening bad reports on my DAC and withholding my last check. Any advice would be great.

i don't really think they can revoke your cdl, but they can withold your last check. if you quit any company and you owe them something, they can keep your last check to cover as much as possible. i used to own my own business in another industry and i had to do this a few times.

Your CDL was issued by a state licensing authority, meaning that Swift has no way to cancel or revoke your CDL. Your commercial driving priveleges are not within their control, whether you work for them or not.
If you owe them money, then you owe them money and there isn't much you can do about that. If you signed an agreement for a loan from them for a certain duration of time, then you owe the money just like you would for any other contract you would sign. At what rate and when you pay them back is an issue to be settled between you and them.
As for turning in the truck, you will have to contact them and see where they want it turned in to. However, when you get there to turn the truck in, get someone from Swift in a position of authority, (such as a terminal manager) and the two of you go over the truck completely and do a complete post trip inspection. Fill out the appropriate forms, and each of you sign it. This will serve as a receipt that you turned in the truck and that they accepted it. After you have that, it's pretty tough for them to make any claims about the condition of the tractor or the location in which you turned it in.
Threats on the DAC? I would love to go in and hear them directly make those threats while I tape recorded their comments. Swift and many other companies abuse the DAC system, and this sounds like a case of it. It can be fought, but not easily.

i know in Florida they can't take your last check all they can do is reduce the rate of pay that they owe you to minimum wage
