Step up to the plate Swift trucking!

    I'm posting this for a friend who is in dire straights down in Riverside. Bob C, went through trucking school and was hired on by Swift trucking. He was in his last week of training and on October 31st this year he was down in Perris California. He and his trainer had arrived in Perris a couple hours before a drop and his trainer was picked up by some local friends to go eat., Bob pulled into a dirt lot about a block away from his destination to get something to drink before pulling into to the DC to unload. Sometime between getting out of the truck and getting back into it he was attacked (Possibly in the truck when he went to get back into it, they (the Police and Bob) really don't know.

    He was stabbed up to 18 times and then stomped and kicked in the head, then left for dead. The Sheriff showed up and called the ambulance. He has survived the attack but is now paralyzed from the neck down. Bob does not live in California so he has no family he is still in Critical care under an alias name for his protection. He has no insurance and no money and is stuck in the hospital until he gets some help/insurance. Here is my beef with Swift.

    Swift is refusing to help. They are saying he was not working so they will not help with anything. He was working, he was in California in their truck, and got out to get a drink! No Workman's comp. Not a penny for him. Not a penny for meds. Not a penny for transferring back to his home state. Nothing! Since they won't help SS and Medicare consider this a legal issue over Workman's comp. They also feel he was on the job so they are not helping.

    F Bob right Swift trucking? Swift needs to do the right thing here and step up. Anyone considering what you have heard here should really consider this before working for these guys. This is disgraceful they would turn their backs on their employee like this.

    unfortunately..i think your freinds only option is to talk to a lawyer at this point.hope your freind get out of hospital soon and back home

    Thats bad but swift is right about him not working. It would be a WC case if he had 1.)fallen off the truck 2.) Fallen out of trailer or many more but when you are out of the truck you are on line 1 as Off-Duty.

    This is one of those instances where you have to be aware of your surroundings more than anything.

    As stated though Workmans Comp covers anything injury related to the job and being out of the truck at a store and attacked is not an on the job injury.

    Well I have to disagree with you on the general comment of having to be in the truck. Stopping to get a cup of coffee I would say you are still at work. That said there was blood in the truck and its safe to say he didnt get in and out again in his condition. They think someone was in the truck or jumped into it, and it looks like he ran or something trying to get away.

    Thats to say the least he was still in training and getting paid by the week (salary) not by the mile.

    Many state, county, city prosecutors have victim compensation funds available for these situations.

    Guntoter is right. My brother was hit by a drunk driver while riding his motorcycle and the drunk had no insurance. He was granted victims fund to help with medical bills and lost wages while off work. From what I here it is probation fees to the state that pay it.

    Now lets say this. I am on a load and I have time so I stop and decide to play a round of golf and I twist my ankle should WC cover that? It is the same principal as he wasnt doing a function of his job by getting coffee.

    We have got that ball started (Victims of crimes) This will take some time. In the mean time he is stuck in a county hosptial ICU, no family there. He can't make a call or any of that as like I said he is paralyzed neck down. He can't even push the help button. He is completely f-ed until the ball gets rolling.

    Yes that link is about him. Apparently the trainer/mentor went to go get a tattoo and left him with the truck, and that is when it happened. I guess they are never supposed to do that. So yes he was in his last week of training I believe (Or fairly close to it)

    prime reason why I carry a 40 cal glock. So sorry to hear this I wish nothing but the best for this driver.
