I Got Fired For Discussing My Hours Of Service

    sorry, but she was fired for being insubordinate. She also does not understand the actual law about HOS, pre and post trip.
    A right to work state, and within the 90 day probation period, she can be fired for any reason, or no reason. There were legal ways to make the delivery on time, she chose not to do them, but to argue with a supervisor about HOS... she will loose any hearing.

    She filed under her case under whistleblowers protection act.



    as to the final outcome, who knows,

    the judge will decide that.

    There seems to be a contest as to how big of a mountain can be made out of a molehill!! ALL of this over 5 minutes!?!? Ignorant at best. I did NOT say stupid; I said ignorant..........because a LACK OF COMPREHENSION of the FMSCA regs was displayed by the OP. Not a great outcome for her.............and hopefully some other new driver may have gleaned some wisdom from this thread.

    and the only person she blew the whistle on was herself...
    She was late with her delivery, due to her NOT know what the HOS require, and DON'T require.

    No judge will ever here this bogus complaint.

    123456 is right. As I read the initial post my understanding is that she was concerned she was going to violate the HOS Rules and when bringing it up was fired. Personally I think it's stupid for her to lose a job over 5 min but to be fired for questioning the regulations is over the top.

    My boss put a memo on our board stating drivers must break a seal of a pre-loaded trailer to check the securement of a load. I took the memo down, and took it to my boss. I showed him the FMCSA regulation stating that drivers are exempt from checking cargo securement if it is not feasible to do so. I wasn't fired. In fact, the boss took the memo and 'filed' it. BTW, this is at a non-union establishment in a RTW state. This leads me to believe that the OP is leaving details out of her story to look like the victim. I will apologize if I'm wrong, but I will remain skeptical. I think there's more to the story that she isn't telling us.
