Central Refridgerated Lies on DAC

    I Drove for Central Refrigerated and made the mistake of leasing a truck and after 3 weeks of sitting and not making anything over the truck payment I started to complain about mileage I was then given a good load routed thru Fontana and they disabled my truck. Told me they were terminating my contract. that was 2 years ago I lost my job and just found out Central Put that I had a Two Preventable Accident on My DAC I haven't had an accident in over 30 years When I called Central to See why this Misinformation was on my DAC I was hung-up on. Does anyone know If I can Sue and what for. I am out of work and about to loose everything. Now I find out that no company will hire me.

    and see what they say...it MIGHT be a mistake...
    BUT IF IT'S NOT ...you CAN make a Req to see accident reports.

    Here's the inherent problem with a lot of these Trucking Companies ... and it's NOT RIGHT ... they can mess you over if they don't like you for WHATEVER Reason... BUT if they say you had a accident of ANYKIND ...there should be a record of it with law enforcement,if there ISN'T ...it's more than likely and fabrication/false report ...BUT to prove that in court and win ...that's hard...

    Called safety got routed back to HR Told there was nothing they could do same runaround but thanks for the info Well just got off the phone with DAC they cant do anything I filed a dispute but Its up to Central again If they don't want to Remove the bogus they don't have to then my only recourse is to write in 100 words or less what really happened yet I have no Idea Why they said I had an Accident I didn't have

    Central had my other half summonsed for school fee's which were well and truley paid off :biggrin_25513: At the time we couldn't afford an attorney so we filed the proof that we had paid the school fee's and surprise surprise the case was dropped.

    Maybe talk to a Legal assistant and they can tell you what you need to file with the courts, asking for proof of the 2 preventables.

    Legal ppl aren't free and central doesn't have to prove anything There is no burden of proof with DAC They can report anything they want and you have to prove you didn't do it. Just like your Credit report. Another thing started by the government given to big business and proven to screw the citizen. What happened to proof of guilt they don't have any because there is none. But NO I have to prove I didn't do anything. Hard to do when you don't find out till 2 years later.

    Jess thank you for your information I found a Class action law suit similar to my problem and emailed the Lawyer everything on I had on Central. Again thank you

    Get a copy of your actual record. They also have a procedure for disputing a record. They HAVE to correct it if it's false.

    Once you file a Dispute with DAC it is Centrals obligation to provide burden of Proof.... DAC also has the ability to pull your MVR, DOT accident reports... I am working with HIRE Right at this time (NOTE Working WITH NOT FOR) as I have had a DAC pulled and sent to me I found something on it that set me off like a time bomb it was done by a company that i have NEVER Worked for.... I have provided W2's to Hire Right as well as a Notarized statements from my Wife, and my Former Employer during the period of time the "mistake" was made...
    HireRight as much as people bash them will work to resolve the problem and if you get the right person involved at Hireright you might be shocked at how much they will help.. I just Got a FULL HireRight report run, it includes DAC, Legal etc that employers pull and it is coming to my house in a Box itis over 1200 pages of paper..
    So they do more than just DAC and many employers use them for verification that is more extensive than most think I was shocked when the lady told me what all previous employers had requested..

    i found out there is a dot recordable accident and a non recordable one i had a flat tire after bumping a curb it was called a preventable accident when a company wants to screw you evrything works in there favor just make sure you do everything you can to set the record straight

    Thanks for the reply's everyone All information is appreciated. I am working with DAC on it but I was told if Central Didn't want to remove it there was nothing they (DAC) could do as they just store the data.
