you must be able to work to draw unemployment, so dont tell them your hurt and you will be able to draw

If you worked to the end then you can draw unemployment. If you were off work before they closed because of a injury then you should still be on workers comp. Collecting money because you are hurt should not be a factor.

Just wanted to let everyone know that use to work for Mid states and was terminated on 3/26/09 without prior notice that I started a Class action lawsuit for failure to give us a 60 day notice, which is the law for Employers to do.

This has nothing to do with our paychecks that we have not received yet or that bounced. This is about, Mid States not give us 60 day notice that we were going to be out of a job on March 26, 2009. Please call ASAP since there is a deadline on filing this lawsuit because of Mid states already filed Bankruptcy. We are entitled to 60 day notice and up to 60 days of pay.

Well, I do have to say, that my hubby, as well as others, WERE looking for other jobs and trying to get out of there. But when you have four kids to feed you can't always walk out of a job the minute there is bad stuff happening. And, I have to say, it is awfully suspicious that after that class action suit involving the insurance stuff, the company was ordered to put so much in at first, then $25,000 every Friday after that, they come to the drivers here in Kansas (I don't know if they did this in other states as well,) and asked them to take a major pay cut. When the drivers refused, the doors closed less than a week later. What's wrong with that picture?
Another thing, a lot of states have laws that require a company to give a minimum of 60 days warning to their employees before closing their doors for good and they are clearly in violation of that. Poor management? Definitely. Feel sorry for the Hartmanns? Not in this lifetime. They could have changed their management practices a long time ago and OPTED to do nothing. Some may have had good experiences with this company but please don't diminish the bad experiences a lot of employees have had with this company because in this case, the bad outweighs the good by a tremendous amount.

I don't think anyone is saying the Hartmann's are not at fault here. Paycuts were taken across the board for everyone. Drivers, Dockworkers Clerks and Managers alike took the 10% paycut. I find it funny that anyone from Kansas would throw the first stone .... remember those of us who live in glass houses should not be throwing stones. I am not sure if there was many in Kansas can say their conscious were any cleaner then the Hartmann's.

There are more people to blame then just the owners of this business I think that there was some bad decision making that played a big roll in this company closing but there was more to it then that.

We should be looking at all the employees who was stealing from this company What about those people ... are they to blame as well ? I am just not talking about drivers or dockworkers, there were managers that was stealing from this company as well ... Does two wrongs make a right ?... not in my book.

Granted the Hartmann's took our 10% paycut... that was 2 weeks worth. They took our funding for our insurance and never paid our doctor bills, hell who knows what they took from us but does that give the right to the people who was stealing from this company ? In my opinion these thieves stole not only from the Hartmanns but they were stealing from the customers who hired us to transport their freight to their customers, they were stealing from the employee group that wanted to company to survive . What about shop workers are they to blame ? I remember a time not so long ago when we were begging for tires for our tractors because they were unsafe to drive ... I didn't understand how the Hartmann's could put us drivers in such unsafe equipment, only to find out we had no tires because the shop people were stealing them and reselling for their own personal gain.

That is very well said but for the Hartmann's their experinces w/ a few terminal Managers and employees and bad decision making has cost them a dream that was handed down from their father. If hind sight was 20/20 I but they would have done it different.

I have been around for a long time and there is so much dirt that can be told about this company and the Managers and the people that they have hired but instead of pointing fingers and dishing out dirt, it would be so much better to let the Hartmann's fight in court to get what is due to their employees ( final paychecks) and close this chapter of our lives.

I know it is real easy for us to blame the Hartmann's for the crap we are going through right now and I can understand why but lets be real about it, if you are going to lay blame then lay it in the right direction.

Re Unemployment Insurance

Hi all of you former Mid States employees. I know that alot of you out there are hurting really bad right now, both financially and emotionally, for the damage done to you by the Hartman brothers. In spite of what LUVDTRUCKING said in his post, in defense of Mid States; what the Hartman brothers did to many if not all of the folks who worked for them was just plain wrong, wrong, wrong, on so many given levels. The level of pain, suffering and misery caused by them, not only to their employees, but to vendors they serviced as well (which incidently is well documented if you Google Mid States Express Inc.) is unprecidented in the scope of what they have done to so many. So while they may think they have gotten away with this; just remmember, what goes around, comes around. Karma is an amazing thing to watch!
Now as to the subject of my recieving unemployment insurance; it was quite fortunate of me to have taken the initiative last Friday to make a series of phone calls to various Wi. unemployment offices to eventually find the correct office with which to discuss my situation. The long and short of my conversation was that in making the call, I locked in my unemployment rate for when I eventually do get a release from the doctor to return to work, wherever that may be. Had I waited til Monday, I would have recieved nothing in unemployment wages, because of the fact that Friday was the last day of the quarter; (Monday began a new quarter) and I had not worked at all in 2008. So by calling in and getting set up on Friday, locking in my rate for wages earned in 2007, I now will recieve unemployment wages. Whew! That was so close! Had I not chose to open this trucker's board on Thursday and read the posts made regarding the closing of Mid States, I would have been S.O.L. in getting any unemployment compensation. While not to sound religious, never the less; I feel the hand of God very well may have been at play in taking care of me and my family. I totally believe if you live a good life and do not do bad things to others, there is a very good chance you will be taken care of.. if you but believe.
In closing, my heart goes out to all of you who who are in the fight of your life to put food on your table, fuel in your vehicle, paying your rent, or just paying the week to week bills. It is my fervant hope that you will find a way out of this and that life will be much kinder to you very soon. Lets all stay in touch and keep one another informed on this Mid States closing.
