This is just a question. Aren't employees considered to be non-secured creditors? Someone might want to ask that when they are talking to an attorney. A memeber of my family worked for a company that also shut it's doors and thats what he was told.

CJROSS, is this a class action suit on behalf of all the employees?

Is this a "Class Action" Lawsuit?

Reading the Warn Act..it states if unforeseen problems cause the business to close no notification is warranted? How are you getting around this? MSXN will just say they were fighting to keep the doors open....???

I would suggest that each of you contact your former co-workers and inform them of this class action law suite. I would ask them to help you make contacts and work together by making some kind of call list so you can keep a count of employees contacted, if you work together I beleive you can get this accomplished.If at that point employees Do Not climb aboard they deserve what they get (Nothing).I have not worked for this company for over a year but I'm willing to help make those phone calls if you would like help????
By what I have read on the internet the word is getting out and news organizations are picking up the your story,However I beleive you have to also ask those contacts to take the time and contact there local news organizations.
As far as the rumor mill about Mid-States re-organizing and re-opening.Stop with the rumor (####)!!!!!!!!!! Report the facts!!!!!!!! Who the hell would ever work for them again after what they have done to there employees and customers???

We should of been still notified that they were "thinking" about closing the doors. The unforeseen problems is not even relievant since they had financial problems for years. I am sure the Hartmanns will try to find a loophole somewhere like Javic did but with all the bad history with Mid states and employees..i don't see any problems neither does the lawyers. I am trying to get ahold of all the drivers I knew from Indy, Toledo and Columbus terminals and telling them about it and they are telling other drivers. I have been getting phone calls from Marion, IL drivers. Louisville drivers and so on. The lawyers are making a spreadsheet of all the employees that want to get involved with this. You can contact the Moderator of this site for the Phone number of the law office. The court date is set for May 14th in Chicago.

Re Class Action Suit for the Warn act

Hi, I am an employee from the Milwaukee terminal. It has been extremely quiet around here with employees of this terminal. I have been off work for the past year due to having undergone shoulder surgery, and quite unexpectedly discovered that their doors had been closed by logging onto this board the day it happened. It was suffice to say, quite a shocker for the fact I had spoken to my terminal manager only 3 days earlier and nothing was mentioned that something like this was in the works. So back to my original question; this class action law suit you are trying to organize; does it involve other terminals than the ones you mentioned in your post? As for trying to make contact with other employees of my terminal here in Milwaukee; I would have no idea as to how to go about doing that, for the simple fact that I do not have any phone numbers or way of getting ahold of them. I am just curious as to if and how this might all play out and or affect those of us who worked here in Milwaukee. Your advice and answers will be greatly appreciated. G

The only thing I can think of is contact the moderator of this site for the phone number of the law firm that is handling the case. I can't post the phone number on here nor give you my email address. This class action is for anyone that use to work for Mid states..does not matter what terminal you work at.

Re class action law suit

Hi cjross65, I sent a private messege to the moderator of this board asking if he would consider contacting you. I gave him my contact information so that either you or the law firm can get in touch with me. I am very interested in getting in on that class action law suit as well. I will tell you this; about three months ago, I contacted a local newspaper journalist here in Milwaukee, and explained in great detail just what all was going on within regards to this company. He declined to investigate or put any effort into looking into it for the fact that that in his opinion, there were not enough people who were residents of Wi., who were employeed by this company to warrant the effort. I then contacted a couple of my fellow employees at the Milwaukee terminal, and one that had left a year ago, to ask them to join me in my efforts to expose this company for the fraud they were perpetuating on it's employees. They just ignored my requests for their assistance. The only reason I can figure is that they were fearful for their jobs at the time. Guess looking back on it, they should have taken me up on my request for help as they got screwed by Mid States just like everyone else did. So much for them being a loyal employee, eh? Just like so many other employees out there, I am royally pissed at what Mid States has done. For the past two years, I contacted so many different offices; congressmen, senators, labor boards to tell them what was going on; anyone who would listen to me, and now.. for what? What good did it do? Nobody would listen to what I was telling them, or they just did not give a good rats ###. What this company has done to so many is beyond the pale of horrific. I think they; (those who have been instrumental in the rape and pillage of the Mid States employees) should go to prison for a very long time, so as to force them to get a taste of what it is like to feel desparate, down and out! It is nothing short of absolutely disgusting what has been done to us.

Sorry everyone it took me so long getting back to everyone but I now know for sure that Brad has taken a job with Central Transport.

I did check with a lawyer this past Friday and he told me that given the reason MSXN went out of business ... Reason: Amcor (Bank) pulled funding because of the credit crunch this economy is in, could stop any kind of class action lawsuit using the warn act. The Warn Act reads: unforeseen problems cause the business to close with no notification is warranted....I guess each lawyer has a different outlook on things but this is I was told.

I asked if there was a way that the employees group could go after the Hartmann personally, he told be he was going to make a few calls and let me know on Monday. He told me that when the Hartmanns filed Chapter 11 on MSXN they also filed on Hartmann properties as well so I or we could not touch them if this was the case.

The lawyer did tell me who the attorneys were that was handling the case if someone in Illinois wants to call them.

He did tell me that I could files a small claims case but being they filed chapter 11 I could wait years before I would be paid if at all.

He did tell me that a employee group can be consider a non-secure creditor, he did tell me that there is a hearing taken place at end of the month for these creditors to tell there stories but he did not give me the date nor time. Maybe again someone in Illinois can look into this.

Well this is all I know for now

As far as Brad going to prison .... why would we want him to go somewhere he might enjoy. Opps Sorry someone said stop spreading rumor and state facts.

Fact: Why would we want him to go to prison, he might in enjoy it !!!
