Getting shafted, and would like some info on where to look, I called several lawyers today and none seem to deal with employment or CDL issues.

I met him at the delivery location so he can take the truck back as the relationship was over. he got pretty shady and refused to give me my paycheck or car keys unless I signed a voluntary quit form and that was not the case. I did make some problems for him so he would fire me because I was not willing to keep working as he required. Within a 3 month peroid, I maybe took 3 legit restarts and the rest were on the road while still working, so they did not happen and I was told to fix my logs so I can keep working. His issue with me was that I was too slow in doing my job, but after working for 3 months 16-18 hour days and not getting any time to rest I was done, plus the promised pay was a verbal agreement and it was told me so I would start working. He refused to give me my check that was due on the 15th and it is now the 21st. and he also stated that I am not getting paid for the last load. what can I do? help please.

File a complaint with wage and hours in your state. It is free and they can get your money. Then call Federal DOT and file a complaint with them, I assume you have logs to back up your story. Oh maybe you should not because you violated the law by doing what he told you. Should have refused to violate the law and let him fire you, then you could be a whistle blower. Too late for that.

No driver is forced to falsify logs. He has you over a barrel; you should have signed the quit form. Take it as a lesson learned and move on with your life. If DOT audits those logs, you're in big trouble.

Resume looks better if instead of "terminated" next to that job it reads "found better opportunity". Move on like Chinatown said. GL!

You forced him to fire you?...I ask why?
I wont debate the situation you found yourself in and who/what is to blame..

I ask what your motivation for forcing him to fire you is?
To sue him(probably)..but you aren't likely to ever see $0.10

To file unemployment?..with the trucking jobs now available I can promise they will send you out to 12 available jobs in the first day...(so again..you wont collect $0.10dime)

    No?

since you already contacted a lawyer I am going say you wanted to file suit and ??..what?
force him to hire you back and make your work conditions improve?..(not likely

You collect a BIG ca$h settlement?

ok..i will play along?..what are your actual Damages?
Ya know?..Injury/disability?..lost time/wage?(he tried to run you TO much and make TO much money)

Im not taking the side of a illegal business owner im simply trying to let you know,if you are going to file suit their needs to be injury/damages..or pain/suffering...

Having been in your situation I have to agree with the others.

You chose to work under the conditions you were in. I understand that you probably felt you had no choice to keep the job. But you did have a choice and you chose to run outlaw.

Not knocking you. As I said.. I was in the same boat. But to say he made you do it. No sir. You chose to do it.

Its good that you quit. I quit and abandoned my truck. I knew when I did it not to expect my last paycheck. For me it was closure and freedom from working for a tyrant. Chalk it up as lesson learned. Move on and dont look back.

The trouble with complaining to the DOT about the hours and logging is that if you were a party to the wrongdoing you can't whistleblow. It's a catch-22 driver screw-job that favors the companies, yep it is.
