That's celadon's(and most other large companies like prime, cr England,prime, etc) way of trying to justify ripping drivers off.

Ever watch the movie 'Fight Club' where Edward Norton's character talks about the process his company goes through to decide whether or not to conduct a recall? Apply that same logic here. If a large company thinks that the potential for profit exceeds the possibility of getting caught and having to payout in court...they'll go for it. i.e. This case. 10:1 odds they made a LOT more money off this scam than they'll ever be forced to pay out.

This is a fairly easy one to understand and I believe it is absolutely rampant among carriers that provide fuel cards to owner operators for whatever reason. Celadon is just the first to get challenged on it. A salesman friend of mine says in order to make big money on a deal, there has to be a sucker involved. Or in this case, an owner operator who sadly actually thinks he is getting a good deal when Celadon tells him that he got a twenty cent discount on fuel. Never mind that they got a forty cent on it and kept half of it.
With that being said, I doubt there is anything iillegal about it unless the contract indicated a 100% pass through of fuel discounts to whoever bought the fuel. With THAT being said, I guess it comes down to whether or not you consider it ethical business to engage in this kind of practice with people who are supposedly your business partners. I wouldn't do it but I know people that would and see nothing wrong with it.
I think the bottom line is owner operators READ YOUR CONTRACTS! Knowledge is power and while ignorance is bliss it is not very profitable. I have long believed trucking companies (some) make more off of their own people than they do hauling freight. This is just one example of how they do it.
In closing I think carriers will have very little standing on this. If I am not mistaken it is illegal to mark up insurance products provided to owner operators, and I don't see how a judge will see this much differently. It is basically marking up goods and services provided to the contractor.
Owner operators educate yourselves. Don't put yourself in a position to be somebody like Celadon's sucker.Lonesome, camgirl, scottied67 and 2 others Thank this. -
and this is the same corperate trash that is pissin and moaning about a driver shortage ? the mafia would be proud of the scams these scumballs come up with ....almost remenisant of when the ny mob got into the gas biz lol.

The whole thing is as crooked as a politician. The part that burns my arse is no matter how the outcome of the case, the company is not going to be hurting for it. They also will still have plenty more drivers rushing to sign on the dotted line in light of the current issue...

What's missing here is the nature of the Celadon's contract ... Do they not state that they are keeping the rebates. But more importantly are they limiting where the O/Os can fuel; restricting them only to those vendors that give them discounts.
Easy to defeat, get your own fuel card through NASTIC or OOIDA ... Uh wait! they skim off the top too, and don't pass all the savings on ... especially OOIDA, they give what ... $.04?
