One Question Who do you drive for
-
I'm not trying to be a wisearse but if you've been driving since 1994, why in the world would you ever go work for Swift? With your experience, even if there are issues with your DAC, you should never have to settle for them...
-
I do not know where you went to school but eight year ago from now 2014 will not add up to 1994 Are maybe you meant to say 2006 that would be about right now wouldn't it which company do you drive for
all the company's there all the same unless your mommy are daddy own it are you are an owner operator then you may call the shots other wise you are just a steering wheel holder -
If you got terminated for violating safety policies there isn't much recourse. From what others have posted it would take 3 incidents in 6 months rolling.
I'm guessing Swift didn't want someone in their truck who wasn't in control of it. -
This sounds like employer retaliation. Even though you are an at will employee, did you ever file any safety complaints , did they ever force you to run over HOS or did you ever complain about the truck you were driving? It is illegal to threaten to blacklist an employee. Under what grounds did you reject this load? If you can prove that it was in any way safety related, maybe due to inclement weather, truck safety, or anything else, you have an OSHA whistleblower retaliation case under STAA. Even verbal complaints you could have made at the time relevant to safe operation of vehicles will count.
I suggest you send the corporate a certified letter detailing why you rejected this load, and note in this letter any safety related issues you might have had. Reiterate any verbal complaints you made. Inform the company in writing that you believe they are illegally retaliating against you.
Abandoning equipment is most likely an exaggeration if you took it to their terminal. The fact that they threatened you as you indicate, is definately illegal. I suggest you consult with an employment lawyer ASAP. There is a very useful website you can find on google where you can post your legal questions and licensed attorneys will respond ASAP for free. -
In fact, research OSHA section 11(c)(1). Swift is a gross violator of labor laws and regularly force their drivers to run illegally. If they did that to you in the weeks prior to your termination , file a whistleblower case on them and let DOL handle it.
