There is no conviction here just failed pre employment and all the dac report says is terminated so u think that is still to bad the worst thing i can think about is his work history is a little unstable because he is always been honest no matter were he has went to work weather its target or homedepot and they dont like it when he says he has failed a pre employment screening

The application process is completely painless and free. Your "friend" needs to be honest up front. Forget to mention something on the application and you will be sent home, because TMC wants honest people in their trucks.

The DAC report should also say whether the company that terminated him, will consider him again for hire or not. Most companies in the trucking industry do no like the word "terminate", because it makes them very nervous, because that could mean anything. That is why when a company is gonna fire you, they ususally ask you to quit instead because they know that it follows you. The DAC report should also say if it was drug screen failure, if it doesnt, then the termination was for something else.

Your "freind" can ammend his DAC report by submitting a letter and telling his side of the story and then everytime they send a DAC report to a prospective employer his statement will go along with it. Im not sure how to do this but I do know that you can every year, I have never needed to do this but somebody on here should know how to do it.

Also, in reality your "friend" should have known that there would be a pre-employment drug screen and if he even thought that he would fail it, he should have postponed his orientation. Another thing that I have run across is sometimes for about $20 you can go have your screen run yourself about a day before the company does it, if you come back clean and you dont for the company drug screen, then you have leg to stand on, I knew somebody that did this just for this reason. Best thing he can do is swear off all the illegal substances--a "dirty" screen will haunt you forever in this industry.

Like I said, then the reason he was terminated is other than a drug screen. Since they have to put that on there by law. My guess is that they have terminated for another reason since they did put "reveiw before rehiring", if the company terminated you for a drug screen, it would say "not subject to re-hire". So there is more going on here than just a failed drug screen, "he" needs to either amend the DAC report, or find out why "he" was terminated by Werner. According to your statement, the company "terminated the lease". There is NO company out there who will take you as a hire without first getting a clean physical and drug screen back--you will not see any contracts or anything until that process is complete. That is why most companies wait until the last day of orientation to have you sign your lease agreement, and if you are a company driver you will not get issued a truck until you are "cleared" which is usually the last day of orientation.

I left orientation once at a company, because they wanted to tell me things that were just not factual or legal, so I left at day 2 and my DAC says that same thing, "review before re-hiring", but whenever you do not complete orientation or do not go to work for them for some reason, it will say that. When I first started driving, the very first company that took me on did a 4 day orientation, then screwed around for 2 months trying to get a trainer driver and a truck for me, well Im not waiting on that-and they put the same thing down on my DAC and also that I was employed by them for 3 months(which has been since corrected), when I told them(the company) that I didnt think that they were for me their answer was "you didnt sign any contract, did you?" So nobody says that you have to work for us. BTW, that company did try to hire me several years later, so did the other.

Best thing again, is run it by safety, or better yet have the recruiter run it by safety and if something is not kosher, they will let you know. The recruiter makes his money when you are given an orientation date and complete it, so it is in his/her best interest to do this since his/her bonuses rely on it. I hope all this helps.

Prsonally, I dont drive for TMC, like I said, but if I were to drive OTR, they are probally who I would go to since in my part of the country, they guarantee you home 46 wkends a year(which is real good). Their website explains pretty good where they run, and how much they pay and whether or not you will have to be with a trainer and so forth. One of the other guys here that does currently drive for them could better answer your questions.

TMC really does suck

I worked for TMC in 2005 before they had the new petes they had flat top freightliners and high rise conventionals and were just starting to get the kenworth t800. I had a flat top freightshaker and was it a piece of you know what, Every week i would break down it had electrical problems what drew the line was when i was in indianapolis making a delivery if you would touch anything electrical you would get shocked I called my driver manager and told him i was right there in indy and asked to get a new truck I was tired of breaking down and getting shocked he told me that just look at it this way, when ever i get tired i could just touch the radio and get shocked to wake up and he laughed.Well I wen t to atlanta to make a delivery was told I could pick up a new t800 in grier South Carolina after i delivered that was another lie my truck broke down and i had to sit for 3 days I left the truck in grier and quit they got me for abandement of the truck and kept my last pay check what a nice company wouldnt you say

What do you expect a company to do if you up and quit, and leave a truck out of position. You sound somewhat suprised they would nail you for abandenment. No matter how upset i was with a company, i wuold think your DM would go to bat for you with the company with a truck like that. If anything, all the loads THEY have find a new way to get moved. I would have just said, once in georgia, "...i'm done driving till i get a new truck. I dont feel safe, and need a new truck." I know...'easier said than done'. But could you not call OSHA on that one??
