I was working for a company in NJ and turns out the guy was a drunk and did'nt comply with any DOT regulations and was about to be audited so was in a big hurry and hired a company to come in to straighten out his affairs.I gave him 2 weeks notice and was told just bring the truck back.When I got to the yard he was drunk and started pushing me around and then reported to my next employer that I refused a random drug test when in fact about 4 days before that I took the pre-employment test after I had already worked there 3 months.I was terminated from the new co for refusing a previous drug test and now get no calls back from anyone for jobs which I'm sure is on the Dac report and I dont know how to get it off.If anyone knows please email me at [Edited Per Policy] the way the company is CRA Trucking in Netcong,Nj

Do you have any of the paper work that you signed/dated when you first started to work for this company?....I think even your log books would work, any ways...You should have been given a copy of your physical/drug test paperwork when you took the test and that should be dated...and if you look closely there is a place on that form that indicates what the appointment was for ie....pre employment physical, random drug test etc.

Take the date that you started with this company (proof) and the dated paperwork from the drug test....this will show how long you worked there, when you started and when the employment physical was conducted. Make copies of each, request a copy of your DAC, if your ex-employer did report a false refusal and it is there you can use the paperwork to refute the charges. I would suggest trying to get the DAC mess cleaned up (if there is a false refusal on it) PRIOR to applying to any more companies.

You said you gave 2 weeks notice and that you were fired by the new company for refusal of a previous test, didnt the new company check your DAC when you were hired?...they must have given you a start date because you had a time frame for the 2 week notice.

You should request a copy of your DAC report to see what is listed on it.

You are entitled to 1 FREE DAC Report per year if you fall into one of 3 catagories.

1.) You are unemployed and will be going back to work with in 60 days.

2.) You are drawing any kind of Federal aid and plan to go back to driving a truck

3.) If you feel there is false information on your DAC Report.

If you do not fall into one of the three catagories then the cost is $9.50 per copy

This includes both owner-operators and company drivers.

Drivers wishing to obtain a copy of employment information previous employers have stored on them may send a copy of their Drivers License and Social Security Card to:

USIS
P.O. Box 33181
Tulsa, OK 74153



You'll need to provide your home address and telephone number along with all correspondence. Keep a copy of your request for your own files

If this is a smaller outfit, and he wasn't keeping good records, he might not even use USIS DAC. He probably is just badmouthing you when the new company calls for a reference.

I have the pre employment test paper and it was'nt on the dac when I started with the new company.They got it from the previous employer request form that they send.The guy I was working for does'nt even own a computer.

thats what he does he just puts it on the previous employer form that the new company sends but now that I was teminated from Ward Truckload Express and they are a big company they probably posted it with Dac that they received that info from a previous employer.

man that sucks. if what you are saying is true you need to get a copy of your dac and dispute it. If not you will be very screwed in the industry

Talk about a dirty trick

This is why I come to this site....to learn.

Let me see if I'm reading this right.....A driver's former company is passing down information on that driver to a new company who then uses it to ream that driver's DAC? Subjective information that is taken to be true? What a can of worms this is.

So instead of information about a driver's sins disappearing after a certain time, say, ten years, the information can stick to a driver's DAC forever.

Just when I was reaching for the phone to call up some good companies about getting back in, I read this. Man, this DAC BS only gets better with each passing year--even each passing month.

I'm not so sure they can post second hand info to your DAC. But Ward might be able to post that you lied/ failed to disclose information on your employment application. I would get a copy of your DAC to see what is on there before I jumped to conclusions.

Yes...start with getting a copy of your report to see what is on it, and if there is false information, CHALLENGE IT.

Joe is right, in that third party reporting of information is not allowed at all. This doesn't mean it doesn't happen, but it certainly is the easiest to challenge and have removed.

If your former employer is preventing you from obtaining employment and offering blatently false information, then see an Attorney and go after him. He is violating Federal law, but from the sounds of things, he's not going to be in business much longer.
