So... He was driving down a narrow street, down the center of the street, which means he has right-of-way with regards to the vehicles behind him. A car that was behind him decided to pass him, and in executing said pass (illegal, I might add, based on the situation), hit his truck.

The way I see it, it was the other driver's fault. Even if he was in the right and was executing a proper pass in a proper passing zone, he still hit the truck when re-entering the lane, which leaves the fault on his side, and not the truck driver's side.

The only thing the trucker could have done differently would be to drive even more firmly down the middle of the street, making sure NO ONE could pass to either side (this is a trick I use when picking up/dropping off kids to help stop the bus stop sign runners--it works pretty well, and protects the kids).

This entire situation would've been avoided if he had a dash cam, or had thought of what I just explained. But I firmly believe he wasn't at fault, based on the available information.

Thank you Lux... I had the same argument with the LEO, but I felt some racial issue against me... I don't know... NOW, in my truck, guess what, I have not only one but THREE dash Cams. The problem with city cops is that they had their mind set that IT IS ALWAYS THE TRUCK'S FAULT! - at that time I didn't have my CDL yet and the first thing the LEO said to me was "sir, I have the feelings I'm gonna take you to jail today" then he went back and forth trying to prove I couldn't drive that truck and that I had to had a CDL, and after many hours another #### head (a DOT LEO) came and did a full inspection on me, and said to the City Cop "you can give him a ticket for all these violation, but he can drive the truck with his license" - well he said a bunch of violation on the truck, such as tire treads, missing rivets on the van, brake, etc, etc - after about 2,5 hours the first officer comes to me with a citation, and I said "why? As you can see was not my fault.."! Well he said that had take all the notes and for me to go and let the judge decide about it. Bunch of BS...

For those asking why i was applying for "the bottom Feeder" (i like that...ha ha)... I was invited by a friend to apply for the tanker division, because I want to have some tank experience since I have ALL my endorsements. Applying for TANKER with them, he said it is a pretty decent pay and I would get $1,500.00 bonus. So, I tried it, because so far I have been driving just dry van.

Well, I will be changing in January to the Flatbed division with PGT Trucking.

Yep... I'm thinking the second a leo says "violations" you should get on the horn for dispatch or someone up your food chain, because that stuff is usually beyond your control.

If this ticket hasn't been disposed of, you might look into a lawyer to deal with it. It's a moving violation, so try one of those traffic ticket dismissal experts, it might be worth the money to do it.

Crazy B....!!! - And so I explained everything!!!

Then she paused and said, "how about this accident in 2008?" - Explanation: I was driving a Straight truck, 26,000 lb in one of those narrow street in Savannah, GA on the center lane to avoid to hit the tree's branch and a SOB tried to cut me off as he passes me, and guess what, he had no time for that, before his lane ended and his rear bumper touched my truck. I didn't see the MF coming, it was too fast, when I get into the brake it was too late. - Any way, not a big of a deal, not serious damage, some scratches... but the LEO that came to the scene gave me a ticket. So, Ms Schneider, after making me to explain all these 10 years of history suddenly just said, "You know, send me some more clarification on my FAX about this accident, maybe a copy of the ticket or something, write some more explanation for me and fax it today.." - I said, "Ok"... As soon as I finished talking to her, I was with my wife on the phone when this person calls me back again, I didn't pick up at this time; but she left me a voice message saying, "I decided, please do not send me anything... We are not gonna hire you. Have a great day.."

All you Schneider Folks, is this for real? I can see now why a lot of folks are complaining about these big Mob Companies...

She did you a favor. Don Scneider isn't there anymore. I used to drive a cabover for them. It was fairly good back then. I wouldn;t work there now. Work history is 10 years. They usually only check driving history about 3 to 5 years. They probably don't need drivers right now.

That is not correct. Work history can be anything the company wants to look at (most only ask about the last 3 years) but commercial driving history is mandated by the FMCSA to be 10 years per item C at http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.aspx?reg=383.35
