Lowe's Is Getting Pretty Shabby Too

Minersville PA (Lowe's DC) ... wait for almost 2 hours to work my way up to their gate (From 1045 to 1235) to get the trailer. Got the trailer and ran as quickly as possible to get to the delivery arriving 17 (2117 Hrs) minutes late. We are "Drop and Hook" at this location. The trailer I was supposed to replace was not ready to be moved until 2455 (0055) so I had to sit there waiting on them. This was the 2nd time in 4 days almost exactly the same situation start to finish. Lowe's called my company and I got chewed out for being 17 minutes late ... even though they were not ready to "receive" my incoming load for over 3 hours!!!

Turned out my case was dismissed the broker had to file a claim under his insurance to pay for the potatoes plus pay my freight bill, storage fee, and dump fee after i showed a receipt from the county landfill for 45,000 pounds at 35 dollars a ton. The receipt was for a load my friend took to the landfill in his dump wagon and i sold the potatoes at the market in atlanta to first guy that had $5000 cash. If these people want to make interstate commerce a game, Im gonna play to win!!!!!!!! Needless to say i went back to flatbeddin after that load..........

Bi-Lo DC in Mauldin, SC

Showed up at 1645 for 1700 appointment with a load of styrofoam meat trays (about 6300 pounds). Had about 6 hours left on 14hr clock. Was directed to dropyard/staging area. Guard finally made it to staging area about 1715 to start handing out door assignments. He put down my in time as 1715 on bill (15 minutes late). I made him correct it.

Backed into dock, went inside, saw the sign that says if you unload yourself you have to be off their dock in 2 hours. No problem, I'm a company driver and they pay for lumpers. Called dispatch, got Comcheck express codes for $235 lumper fee (to unload just barely over 3 tons?!?)

Went back out to truck, took a nap. At 2200 I got up, dock light was still red. Went inside, asked nicely if they had an ETA on having my truck unloaded, as I was nearly out of hours. Was rudely told "We'll have you unloaded when we *GET* you unloaded, and not *ONE MINUTE* sooner. You just go back out to your truck, and when the light turns green, you're done."

Okay, no problem. A couple hours later, the light turned green. I went inside and got my paperwork, made sure the in/out times were on it and it was signed, got my lumper receipt, went back out to the truck, pulled up about 2 feet so they couldn't lock me back down to the dock, and went to bed.

An hour later, the knock on the door happened. "We need you to move your truck."

"Sorry, I'm out of hours. Federal law says I can't drive."

"You can sleep in the dropyard across the street."

"Not gonna move this truck till the law says it's legal. If I pull out of this dock and your yard dog comes screaming down the row and hits me, it'll be my fault for driving over hours."

"Well, when *can* you move this truck?"

"I'll move this truck when I move this truck, and not *one minute* sooner. You just go back in your office and have a seat, and when you see this truck go by, you'll know I've moved it."

I went back to bed.

For some reason, they've never sent me back there

I believe I would have unloaded it and kept the money. Good call on not running over your hours though. Safety first.

They can reopen the case because what you are talking about is a civil case...

Since it appears that RoadRocket's alleged little indiscretion has raised a couple of eyebrows, I thought I''d offer my considered opinion (worth about 2 cents nowadays). As a retired police officer from here in South Florida and having obtained my Juris Doctorate in law, let me attempt to put this subject to rest.

Initially, from a sheer personal standpoint, good for you RoadRocket, I like your style. Score one for the good guys!

Secondly, whether the fact that double jeopardy fails to lie in a civil matter is irrelevant, because information on this site is strictly "hearsay" under the rules of evidence in every state in the Union and could never be used as evidence in any impending or subsequent civil or criminal action in the first instance (notwithstanding no level headed prosecutor would even consider filing an "Indictment" or "Information" (depending on the State) for perjury based upon any such spurious, specious and frivolous alleged evidence). So feel free to boast RoadRocket, I enjoyed your story. As for any opinions to the contrary, respectfully... please give me a break with the elitist Shirley Temple mentality. (Not pointing out anyone in particular)

Finally, had I been in RoadRocket’s place, having myself been on the receiving end of many of the injustices out here, I believe my reaction would have been strikingly similar, albeit my tactics may have varied based upon my own personal knowledge and experience.

Jinny Beauty Supply, in Chicago.

A lot of their shipments are inside deliveries, and they have a tendency to ship containers marked "corrosive" and not tell you. Their skids come wrapped in black so you would never know you were carrying haz-mat.

ANYTHING going into Fort Campbell army base in KY!! Hubby and I were given an appt to deliver for 9 on a Saturday morning. We got there, had to go thru all sorts of clearance, got to the dock, only to be told that the supply Sarge was gone for the weekend and we would have to wait! So we decided to go to the t/s just about a mile from the base... Only to be told we CAN'T LEAVE the docks! No bathrooms, no food, nothing! AND it was 90 something degrees with hideous humidity, and they tell us we cannot idle the truck!! I finally got a blasted officer and got a pass to leave! I was sitting there thinking Good God.. what are we? Prisoners of War? NEVER NEVER NEVER again!
