I recently talked to a recruiter and was cleared to go to swift training academy. But I have an issue I'm worried about. My background check came back clean and my dmv was clean except for a license suspension for failure to pay court ordered installment payments. I told the recruiter that the payments were from a civil court case between me and my ex. When in reality it is from a misdemeanor case that I got expunged. The misdemeanor happened a little over a year ago but the charge was dropped after I paid the fine. The license suspension happened because I was late on paying the fine. The misdemenor is now expunged from my record which came up clean when they ran it.

My question is, will they bring this up again after I go through school when I go to orentation? Will they want some kind of proof of what happened or am I good to go once they clear me to go to school. I just don't want to go through school only to get sent home at orentation. I have a good paying job I have to qiut to go. What is the hiring process at swift?

they could bring it up again, take proof just to cover yourself if you can obtain the proof or already have it.

If you have a good paying job then why go to Swift? You wont make much money, im making a ton less than I used to and im considering going back to my old field of work or finding a local company that will pay more. dont get me wrong I LOVE driving but its lonely and I miss my family a ton and I feel the money hasnt been worth living in a truck for a month at a time.

If you lie and get caught? It could go on your DAC. Then it will be there for 10 years!

I had some stupid suspensions of my license, one in '82, one in '90. (both state of Florida screw ups!) You can bet your tushie I report them to this day! They do show up.

"In the United States, criminal records may be expunged, though laws vary by state. Many types of offenses may be expunged, ranging from parking fines to felonies. In general, once sealed or expunged, all records of an arrest and/or subsequent court case are removed from the public record, and the individual may legally deny or fail to acknowledge ever having been arrested for or charged with any crime which has been expunged."

Plant was right about a expunged record. I can leagally deny it ever happened. Even if it did come up I could leagally tell them the information is wrong go back to the background company that they used and they would have to remove it from their records once I showed them the signed court order.

With that being said. A company has a right to deny employment for any reason they see fit. So the chances of them saying I could come back after I got it fixed would be slim.

A lot of people think that trucking companies have magic ways of finding things from your past. When really the people that had things found out were people that still had something on public record. Yes they can dig up things from when you were young. Some people don't realize that stuff never gets earased unless you get it earased. All the trucking companies have to do is run a basic background check where they check public court records and there it is!! It's illeagal for someone to give out information from a sealed record. I really don't think anyone would risk their job or risk getting sued just to give a trucking company sealed information.

Unfortunately with computers being so linked up today its also possible that your information could be stuck out in cyber space somewhere. Like if you have had a background check before your expungement. The background company could still have the old info on their computer. The only good part about that is if you are getting a new background check done on you the companies are supposed to be regulated and they are supposed to update your files with the new information. So even if a company has a record on you. Once they check the court public record again and it comes back expunged they are regulated by the fair credit reporting act to use the new information. But sh#t happens! And sometimes it still gets reported.

I'm not worried about my old record showing up. I know it's been earased and I now know if a background check is done on me it comes back clean.

My worry is that I don't have proof of the story I told them. And from what you guys have told me and what I have read they are going to want proof. It doesn't sound like they will just take your word on anything. And if anything at all cannot be proved, even a small thing, they will send you home.

So now I'm thinking my best bet may be to either check swift off the list of companies I can work at or call them back and tell them the truth. Which since I lied will probably mean they won't hire me.

I applied at a few other companies and wrote down the truth. Unfortunately they don't seem to be calling me back. Swift called 2 minutes after I filled out the online application!!! Maybe the other companies don't work that fast or maybe they arent interested in me. I will call them up this coming week and find out.

Now my question to you guys is would you call swift back and spill the beans and see if they were still interested or would you just walk away from that one? I can't see how they could put it on my DAC.

you could always run your own background check which will cost some money just to see if anything shows up, if its been expunged then they shouldnt be able to see anything to deny you.

    Rug_Trucker Thanks this.

Nothing shows up on my background report. Swift just did one on me and said it came back clean. My problem is the license suspension on my dmv report because I was late paying the fine for my expunged case. Instead of telling them about my record I made up a story about my ex taking me to court and said I had to make payments for that. But now that I look at what you guys posted I would bet they are going to want some kind of paperwork saying she took me to court. Which I can't produce. So I think I'll just call them back and tell them the truth. The worst they could probably do is not hire me.

just make sure to explain why you lied etc, the recruiters want to get people hired so they can make money, they might look past some stuff.
