Fighting a preventable with Swift.

    I know a swift driver who hit a cow that was standing in the road at 3a.m.....swift charged him with a preventable...because he said he was doing 62....aka up against the governor.....it was a brand new truck....thats the real reason in my opinion..

    Probably a company driver, driving a Volvo with those horrible lights.
    This is one reason that I try to never run at night. I just can't see far enough with those lights, unless I want to run at 30 MPH.
    Even with the fog lights on, I can't see far enough ahead to avoid something 2-3 seconds away.

    I've been told that I am expected to run the loads at the times given.
    I just shine it on, and run the loads as I see fit.
    I do the Mac9 with my own times, and let the chips fall where they will.

    You could state you intend to contact 4 wheelers insurance and take fault if they gone give it to you.

    Nothing in this clause will save the OP.
    The OP was not struck in the rear. He was clearly struck in the side. It doesn't matter if it was the rear side, it was the side of the vehicle, nonetheless.

    On another note,, visualizing the collision from the OP's description, there is also a "chance" that the other driver intentionally struck his truck (trailer actually). The 4-wheeler would have been on the merging lane, alongside the OP's truck, just prior to impact.
    Now ask yourself... who in their right mind, no matter how careless a driver is, is going to turn INTO a tractor/trailer alongside of them??

    I could understand if the 4-wheeler struck up toward the front of his truck, but not at the rear tandems.
    The OP's trailer and tandems would have been towering right alongside of the 4-wheeler driver's window.
    I would not rule out this being an attempted lawsuit scam. jmo

    I had a 4 wheeler run into my trailer tandems a while back. I felt a slight movement and looked in my mirror. All I saw was a red car that looked normal to me so, I kept on trucking. A couple minutes later, another car come up to my side and motioned me over. With caution, I pulled over and the driver told me that red car hit my tandems, and than pulled off at the next exit. I went back and looked, sure enough, it hit my tandems. I took pictures and called the boss. Never heard nothing else about it... They were probably on something, or just felt so stupid that they couldn't bring themselves to do anything but get off the highway..lol

    I had the same exact thing happen to me ...lmao....it wasnt on the Pennsylvania turnpike wasit? Lol

    I'll be honest, I cant remember where it was..lol It was around 2010 Picturing in my head right now that time period and no, it was not in PA It was out west somewhere. I can picture the highway but, not enough to tell where it is..lol I wish I had a memory like a very few, they remember everything that has ever happened in their life.

    I never felt it..just happened to look back and see it....I couldn't pull over for a few miles it was in a construction zonne. Tbey musta ducked off somewhere cause they never showed up....no damage so I rolled on...I think they were drunk. And probably needed an underwear change.lol
