    No can do swift has an NDA with smart drive and smart drive does not have to relase any video to swift it does not deem worthy and or a liability. there would have to be some sort of freak accident to even put this into limelight and even at that point smartdrive or swift would probably quash it in there own best interest. So unless that video ended up on youtube or something there's no way to go after either company.The driver has no control or idea of what exactly comes off truck.

    And yet, I consider myself to be below average.
    I am quite the lazy driver, as some on this forum will attest to.

    I like, and will attempt to acquire, no less than a 12 hour sleep break. A 10 just doesn't suit me, or my lifestyle. I like to relax between driving shifts.
    I want time to watch a few shows, fix a good meal, have time in the morning to wake up and enjoy my coffee...
    I normally don't do ANYTHING that would increase my miles for the week. If I have a lot of time on a load I seldom try to deliver early or t-call. I enjoy the extra time.
    Like I've said, I'm not in it for $$$.

    I've had plenty of weeks when I've just made by. $300-400, before child support and other things were taken out.
    Many times not being able to eat without taking an advance on pay.

    I really don't know what 'average' means, because we are all unique.

    It does not matter what the device may record in terms of audio/video, you would attack what it is capable of recording. In this case, it is in Swift's trucks, so they can be held responsible, not just the equipment provider. Read up on different privacy and wiretapping laws. Such a device could violate different laws depending on what city/county/state the vehicle is in at any given time.

    The ACLU will not even touch this as it is swift's right to install anything on the trucks they own.That includes lease trucks still under IEL contract by the way... Check your contract IEL 6(b) other operating expenses. As in they can charge you for the installation and price of equipment. ALSO 6(d) FROM TIME TO TIME,LESSOR MAY,AT ITS OPTION AND EXPENSE,MAKE SUCH ALTERATIONS,ADDITIONS,OR IMPROVEMENTS AS IT SHALL DEEM APPROPRIATE. This is as of Jan 2013. so if you leased after this point they can and might put an eye on you and even charge you for the equipment just the same way they do for a qualcom

    But then, that leaves every driver to become a lawyer - just to protect him/herself.

    Why should we need to be conversant on every law and regulation in every single state, not to mention the feds and how they interact with each other, just to stay safe and legal while doing our jobs?

    Any employment agreement/lease agreement does not trump existing Federal/State laws.

    This is true depending on if you are in a one or two party consent state but the driver is at fault for not protecting the right of the person who is not giving consent even if both of them are being recorded with or without consent of any party regardless of who makes or has the recording. Wiretapping without authorization is a felony. Arizona is a one party consent state so by being the driver of a recorded truck under Arizona law that is implied consent on the part of the driver willing to be in that truck even if the video it makes it out. :(

    I have worked for a company that had the cameras in the past. I can tell you, do your job and it doesnt matter! Every company will have this within 2 years, why it protects you and them. Think about it..if you are the professional driver and you drive as such your camera will show that. If you are an accident waiting to happen you will not be driving, it is no different than the electronic logs, it is safer with them period! I had a lawyer once tell me dont ever do anything you dont want to see on CNN or Fox News, you are recorded on your phone, yes those apps track data, websites, how you calletc... at the bank, at the pumps. Some day that camera might save your rear end. While yes I am a student at Millis Transfer the first videos they showed us was 2 big accidents, both cars crossed the center line, and the Millis Drivers did everything they could to miss them, both cars hit the trucks near head-on...you could see both divers in the cars texting on a two lane. Both Millis Drivers cleared. Welcome the camera.
