    You can be over your 14 and use line 5 to get to a safe haven if you are just getting finished at a dock and have to leave. I have had it that as soon as put in a gear leaving a dock it will start to beep at me saying in violation. Hurry and go to line 5, and it stops. You can also use it if you have had a pplan sent to you, but have not accepted it yet. Now this is the one that is vague,

    A driver’s commute to and from the terminal (normal work location)

    the problem with pushing against your clock. is you have to fit a inspection in there. sure, you can over on onduty. but the box i once ran, nagged at me for 8 days.

    Squieak, I got popped for that once, preplan on me but not accepted yet. Line 5 looking for a secret stash mt trailer i had saved in my gps, before accepting load. Log violation.

    It was explained to me, you can swing into a Swift Terminal and drop your loaded trailer and bobtail out the gate line 5 for your 10. Or you can bobtail from the terminal for home time off duty driving only if you are returning to that same terminal after hometime.

    Also you cannot be past your 11 ,14 or 70 and driving your truck off duty or not.

    Skate Board,there wa a story in The Trucker newspaper about an owner op who took his empty truck and trailer back off duty driving from Arizona to Arkansas and was popped at the weigh station out of service because the weigh station bear did not believe he would be returning to Arizona off duty driving.

    one company i worked for, had a driver dh home from arizone to michigan. got popped in oklahoma.

    I deadheaded home 3 times from Texas to California, once on paper logs off duty driving and twice on p Elogs off duty driving. I even got pulled into Chowchilla scales Level 1 and passed lol. They asked where I was coming from, I said "Lancaster" I guess they thought Lancaster CA but it was Lancaster TX.

    They have really tightened down the opportunities to use off duty driving now.

    I live in NH and do it a lot with no current log book. I'm bob tail and every once in a while I have a friend who wants a ride so we head up to Maine to the LL Bean flagship store. I've been stopped twice. Both times for an off road diesel test. That happens a lot up in NH, VT and ME. They check my log book and it's not current but I tell them it's personal conveyance and not a problem. Maybe you people are right but they've never bothered me.

    I was told you can BT up to 3 hours as long as you have NO trlr, They said nothing about having a pp on you but if you are advancing to your PU thats a NO go. MY DM said just keep it to a min and you will be Ok. I took my truck home and drove about 80 miles to my sisters house and there was no problems with that. When I leave the terms I do get asked where I am going once I said shopping why? they said oh ok then I said does it really matter I am an L/O and the gate came up drive safe. In my eyes its just like a leased car but you can only drive it 3 hours off duty, you CAN add stuff to it and any damage you do to it needs to be fixed before you return it or you will get charged for it.

    Actually you kinda sorta get charged or it depends ... If you are buying the truck out it doesn't matter. It's yours.

    If you are turning the truck in and leaving the company you get a wear and tear credit and credit for any life left in your tires. As long as any damage does not exceed those credits, no charge ... and any left over tire credit comes back to you.

    If you are leasing another truck or purchasing a program truck, any over mileage credit as well as the down payment is also available to mitigate any damage.

    As for line 5 .. right form the O/O web site ... the same one we get our statements from ....

    Owner Operators and their employees may record personal usage, as defined by this

    Policy, of vehicles leased to Swift Transportation, as Off-duty Driving. All driving not

    defined by this Policy as Personal Usage/Personal Conveyance shall be recorded as

    On Duty Driving, in compliance with FMCSR 395.2.

    Company Drivers are required to record all driving of Commercial Motor Vehicles

    operating under Swift Transportation Operating Authority, as On-Duty Driving.

    Swift Transportation Policy for Personal Conveyance Driving:

    1. All Personal Conveyance driving shall be “bobtail” tractors only. Any driving with

    a trailer, connected to the tractor, including an empty trailer, shall be On-duty

    Driving.

    2. Driving from a Swift customer or vendor location en route to the Driver’s

    Terminal, normal work reporting location, en route lodging or home shall be

    considered On-duty driving.

    3. Driving which repositions a vehicle for more favorable dispatch, shall be

    considered to be in support of a business involved in commerce, and considered

    to be On-duty driving.

    4. Cumulative Off-duty driving time (Personal Conveyance) shall be limited to three

    (3) hours per day; “per day” is defined as, midnight to midnight.

    5. With regard to FMCSR 395.8, Regulatory Guidance, Question #26, this Policy

    stipulates:

    a. Driving from the Driver’s Terminal or normal work-reporting location and

    his/her home, may be considered Off-duty driving.

    b. Driving to return to the Terminal or normal work-reporting location from the

    Driver’s home, may be considered Off-duty driving.

    c. Drivers who drive to their home in an Off-duty driving status, and are then

    dispatched from their home without returning to the Terminal or normal

    work-reporting location, shall be considered On-duty driving when

    departing from home.

    d. Time spent travelling short distances from a driver’s en route lodgings

    (such as terminals or motels) to restaurants in the vicinity of such

    lodgings, may be considered Off-duty driving.

    Fed law says up to 3 hours a day if you are a l/o at my last check and I have not had any issues with it. Also must be bobtail.

    That's Swift policy, NOT federal law!

    The federal law is purposely vague.
