Teamster Negotiators Call on Company to Return to Multiemployer Talks

Performance Transportation Services, Inc. notified Teamster carhaul negotiators late on Thursday, May 29 that it has withdrawn from multiemployer contract talks. Union leaders quickly informed the company that it has no right to withdraw from the multiemployer bargaining negotiations, which have reached a critical stage after several months of intense bargaining.

The deadline for bargaining is midnight Saturday, May 31.

"PTS has no right to withdraw from multiemployer negotiations and we call on PTS to return to the multiemployer talks immediately so that we can reach a tentative agreement by the Saturday, May 31 deadline," said Fred Zuckerman, Teamsters Carhaul Division Director and lead negotiator. "PTS must return to the multiemployer talks immediately."

"PTS' actions are disrupting the negotiations at the 11th hour," Zuckerman said. "Given the state of the auto industry, PTS' irresponsible actions could jeopardize an already weakened auto industry."

PTS and its subsidiaries — E and L Transport, Hadley Auto Transport and Leaseway Motor Transport — employ about 1,200 Teamster members. Combined, PTS' subsidiaries are the second largest Teamster carhaul employer behind Allied Holdings.

I met Fred Zuckermann a few years ago in Vegas -

he seemed like an incredibly patient and bright man...

if he is at wits end - I wonder what all has been said and done "off camera".

What a suprise that PTS is screwing things up for the union. Don't worry, if the Teamsters strike, Fleet Car Carriers will go in and haul the cars for half the rate.

Looks like PTS has filed bankruptcy again, according to the teamsters site, and are demanding 15% concessions. The teamsters are doing a strike vote. I wonder how long PTS can hang on. I also wonder what it is that they do differently that Jack Cooper and Cassens do, that doesn't allow them profitability. Say what you want about Teamster pay and bennies, but companies like PGMT, and Accurate, and a slew of other non-union carries pay big $$ and have decent bennies to boot according to drivers I have talked to there. I would say that there is some obvious signs of mismanagement at PTS.

Carhauling Company Asks Bankrtupcy Court for Wage Cut

In the 11th hour of negotiations with the Teamsters Union for a new carhauler labor agreement, Performance Transportation Services last week filed for 1113-E relief in bankruptcy court, asking the court to approve a 15 percent wage cut for its approximately 1,300 employees.

Section 1113 (e) allows a debtor to ask the court for temporary or interim relief on an emergency basis. The company must show that the changes sought are "essential to the continuation of the debtor's business" or needed "to avoid irreparable damage" to the company. This part of the bankruptcy code gives the court more latitude to determine changes to a collective bargaining agreement.

The filing followed the company's announcement May 29 that it would withdraw immediately from the multi-employer car hauler association and multi-employer bargaining. Jeff Cornish, president and CEO, explained in open letters to employees that this will allow the company to deal directly with the union, because its circumstances, he said, are now financially much different from the other companies in the multiemployer group.

Action Set to Begin Morning of Monday, June 9

On Friday, June 6, leaders from local unions that represent PTS carhaul members unanimously approved a strike against the company beginning at 9 a.m. (Eastern Daylight Time) Monday, June 9.

“We are striking to enforce our bargaining table positions on wages, hours and working conditions,” said Fred Zuckerman, Teamsters Carhaul Division Director and lead negotiator for the national carhaul contract.

About 1,250 Teamsters are employed at PTS, also known as Performance Transportation Services, and the company’s subsidiaries: Leaseway Motorcar Transport Company, E. and L. Transport Company, Hadley Auto Transport and Transportation Releasing.

I am not comfotable with this strike - it is much more difficult to gain position when the economy is crappy....
