| I Need Help! I have been cut off from my husbands company. I am not allowed to contact, email or otherwise speak to anyone there. I have asked them for information pertaining to his Health Insurance Policy so I know who its under, what it covers, and what doctors, etc. I will need this to make his doctor appointments when he needs them. I have also asked for his paycheck stub reciepts so I can do out taxes. I have been refused. In no uncertain terms I have been told I have no rights and have no say as to my husbands future. They have told me that Mark has to request these items and that they want nothing to do with me. What can I do? I tried to do it in letter so I had proof that he hasnt received them. Theres no proof when its done by phone. And after a truck breakdown he had in Orlando over the last 3 days, they refuse to answer his emails or talk to him. I really need help here on what to do. He has not been able to access or has received any check reciept stubs and does not know whats being taken out or if hes being cheated. And its gotten to the point that Im washed out, put out and ready to leave. |

| Here goes, I'll try my best. He has put down in his papers that Im his partner/teammate when he first started. I have been trying to get his paycheck stubs not just for taxes but also because we beleive hes getting *****. I only told them for tax purposes. I have also asked for his health insurance information. He said he needed to make a doctors appt. because of his blood pressure, and I need the info to do that. In the process, I have also written them e-mails (one his 2nd week out) about problems with the truck that were reported and not fixed before he left the lot with it. I will state first off he has signed on as a short term lease operator(which I thought we'd talked about NOT doing), but its done. It is a 2007 Kenworth T600. It is supposed to be under a 575,000 mile 4 year bumper to bumper warranty, and a 550,000 mile engine warranty. He never got copies of those papers with the lease contract. Meantime, Im still trying to get this information, and they are sending me nasty emails in response. He has told them to give me whatever info I wanted, but they want a signed consent form. And every load he gets is away from headquarters, so how is he supposed to stop in and do that? All while dealing with him breaking down in Orlando, the truck quit shifting all together and kept coming up "Fail", he had to call road assist. This was at 5:30 a.m. only 2 blocks from his delivery site. It took the company till 4:00 p.m. to give him the number to road assist. Road assist got there in 30 minutes. But the butthole couldnt get the driveshaft disconnected to tow it, so he cut it off. Anyway, finally got the truck and trailer towed into the Dealership lot around 6:00p.m. It was left sitting for 2 days. Meanwhile he had to stay in a hotel, they wouldnt let him stay in the truck. After 2 days, they got it in for repair. Said it was dirty connectors and wires, replaced the driveshaft peice, and a hydraulic hose line. Then made my husband pay for it. Now I ask you, if its under the bumper to bumper warranty, should he have paid? Well, he did, and then they refused to give him a receipt! They faxed the receipt to TransAm and would not let him have his copy. I told him I wouldnt have left without it! Even if the law had to be called, because he paid for it, its rightly his. Now he's back on the road, the truck aint fixed, its doing the same again, and TransAm took his maintainance account(hubby was having 5 cents a mile put in for this kind of thing), and took this weeks whole paycheck and says he still owes them $35.00. !!! Plus they put the breakdown as his "Hometime" so he had to pay for the hotels. And lost his hometime. Meanwhile, were'r still getting nowhere with the other info. So I know they are *** him, but until we can get paperwork cant prove it. Also, all my utilities have come due to be shut off. I got my parents to pay the electric, but as of monday if I dont come up with money, my tv, phone, his phone card, and internet will be shut off. It just beats all. He has requested all the information himself over qualcom, but they refuse to respond or answer any questions. He has a walk out lease, but if he does that then he will have to pay for their schooling, the schooling he got his CDL with. Which comes out roughly around 10,000.00. They could also put false #### on his DAC and we'd have no way to prove it, not to mention being broke and trying to get him and all his stuff home. So he said he'd stick it out for the 6 months and try to make enough loads to make a difference, in the meantime try to get proof of everything they are doing. His satellite never got fixed either, its still sending out distress signals every time you turn around, and they are charging us the $75.00 a pop for it. Plus hes had dispatch tell him if he refuses a load to come up there, he will be fired. And they give him directions to closed roads with no re-route. Plus they have been calling him on his cell phone (its pre-paid, all we could afford) and using up his minutes cussing him out for sending the signals when he's not. Ok I guess thats about it. Oh, did I mention hes only been driving a month. But with the schooling and testing and driving he's been gone since June 19th. Only had one weekend home in that time. I probably forgotton some things but your probably asleep reading this now. Any help or suggestions would be appreciated. |

| Hes decided hes going to try to stick it out. At least until his 6 months contract is up. Meanwhile still trying to get his paperwork, and getting nowhere. Everyone says he signs for it they gotta give it to him. Well, someone needs tell that company. Ive been told "no paperwork" "no comeback", well DAH. There has got to be some way to make them give us the paperwork he has to have including the maintainance receipt they made him pay for. He called the garage this morning to tell them to send him a copy of the receipt to his home address for our taxes. They flat out refused and told to contact transam. I am really pissed. I know theres got to be a way around all this #### to get it. Im tired of being pushed around. Hes done everything he was told to do and they still are ignoring the paperwork and refuse to answer him on it. Some good news is I get to keep my phone. The phone company called me this afternoon and told that someone has come in and took care of it. I sure do apprechiate them whoever they are. |

| Eagle - It is HIPPA (I think) Laws. Request the form from everyone....trucking company, doctors office, insurance company, etc. You both have to sign them for them to release information. Most companies can fax the form to you and you mail it back. I have had one instance that we were able to e-mail a consent and one instance that I was able to fax it back. Don't plan on those though. Pay attention when filing out these forms. MAKE SURE YOU HAVE THE DATE STARTING NOW AND THE DATE ENDING AS NEVER, FOREVER, ETERNITY, ETC. ALSO MAKE SURE THAT YOU STATE THAT YOU ARE ABLE TO RECIEVE ANY AND ALL INFORMATION THAT YOU REQUEST. After you return these forms, you should be good to go. MAKE SURE YOU HAVE A COPY OF THESE FORMS FOR YOUR RECORD. We have sent in a HIPPA form only to have them say that we didn't. I was able to pull up my copy with date in hand. Also would work if you had to fax a copy or scan and email a copy to prove it. They are right, even though hubby has consented and even possibly signed a Privacy Act paper, they DO NOT have to give any info and are technically bound by law to with hold his info. The HIPPA form is what you have to have signed for them to legally be able to give you his info. Any company that gives out personnal or private information can be penalized. Always get a reciept or pay with debit or credit card. Hubby's check is direct deposited and he has a debit card that only HE uses. I just make sure he has funds in there. Using debit or credit comes in handy when you need to prove something. Besides requesting those HIPPA forms, do everything else in writing and make yourself a copy of EVERYTHING. I have a plastic bin with paperwork and such up to 10 years ago. Once papers pass the 10 year mark they get shredded. I keep similar papers filed together through the year and in February I empty my folders, staple them together and they get thrown in that bin under that particular year. Some people would say you can trash important papers after 3, some say 7 but I have known the IRS to come after you up to 10 years later so I keep everything for at least 10 years. | I haven't seen my boyfriend for a little over a month now and I miss him terribly. I was almost certain I was going to see him this week end, but he had to pick up a load in Montreal and head to California |

| I sent them an email last week, basically asking them if they would work 70 hours a week for free? And if they won't then they should not expect their drivers too either. And I also asked them where his maintainance account went to or did they steal it? I also told them I was not happy with the shady dealings theyve given and done to my hubby. Well, yesterday the company contacted my hubby and blew his ears off about my email, and told him to tell me that if I ever contact them in any way email or otherwise they would take recompense against me. They told him I sent them a nasty email. Well if accusing them of shady dealings and stealing is nasty then yes I guess I did. My hubby was supposed to have 2 more loads to go this week. Well he's picking up a load in amarillo tommorrow and they canceled his other two loads and told him to have the load and truck back to olathe, KS. by Thursday. All I know is, he better stand up for himself and not take the earful of #### they've been giving him. He told me tonight that he's got his stuff packed what he could fit into a duffle bag and a box. I just dont know how he'll get home to Tennessee from Kansas with no money, and I dont have any either. He's not had a paycheck in 3 weeks now. He's been driving nearly 6 weeks with only one check of $400. That payed the house payment. I just pray if he does get let go, or he walks from this(he said his lease was a short term-6 mo. walk away lease) that he can find a ride home. Keep him in prayer.
