I have addressed this issue in another thread.
My comments being along the lines of, "It's inhumane to make an animal sit in 100 plus temperatures" inside the cab of a truck, but it's OK for a HUMAN to endure???"

This is what is expected of a "driver", be it a company driver, or an L/P. or O/O.)
Without an APU, (which MOST companies won't provide) the driver is left to sit in extreme temperatures in his cab.
Even the companies that DO install an APU, you are charged, at minimum, $65 per WEEK for the APU. OH, and you are ALSO charged the purchase and installation fees.
Hubby will spend the next 3 years paying for this APU, at $69 per month.

YES, we know the math does not add up..
But, payit,or .......P/U, deliver , get SH"""T loads....

Here's an Update on the court hearing today.

A once homeless 73 yr old man was in Federal court Thursday, fighting to get his dog back. But the hearing never happened.
Instead , the attorneys met with the judge behind closed doors. The judge told both sides to try and resolve this out of court. If they can't, they can come back in 30 days.

Mr. Miles Thomas walked out of the Federal Courthouse with his attorney, Andrew Ostrowski. But no dog!

" I can't get into the detail of how it'll be worked out. I hope in the next 30 days, we can put this litigation behind us and move forward," said Andrew Ostrowski, attorney for Miles Thomas.
A federal judge ordered Amy Kaunas, the executive director for the Harrisburg Area Humane Society, and Ostrowski to work it out, outside of court.
" I'm going to follow the judge's orders and not comment on the case," said Amy Kaunas, after CBS 21 News asked her where Baron will be living, while they continue negotiations.

Kaunas left the courthouse quickly and with security. The Humane Society told CBS 21 News, that they had to hire protection, after receiving a number of terroristic threats, because of this case.
( She was walking out of the courthouse with paperwork as thick as an encyclopedia)

" It's been rough, it's been rough. I miss Baron so much. He's such a part of me," said Miles Thomas.

CBS 21 News has learned that during the 30 day negotiation period, Miles Thomas could be allowed a "few" visitations with his buddy Baron.

This is going to Kill the man. (My Opinion), he doesn't need to be going through all this. He already has a heart condition. I seen him on TV and he looks very distraught.

Thanks for all your contacts and concerns above.

Twenty years ago, Miles D. Thomas was a successful stockbroker, and president of the school board in Harrisburg, Pa.
In the past two years, life has been less kind. He LOST His Wife, His Home and NOW His Dog, his companion!

I'm thinking the judge was going to have to rule against the old guy
But felt sorry for him and hoped it could be worked out with him ruling

I can see both sides of this, regardless of your belief the window rolled down means nothing nor do the temps outside. The law is very clear here, you are not allowed to leave a child or an animal in a vehicle unattended. 70's quickly becomes 90 in under 30 minutes in direct sunlight. 90 degrees becomes well over 100 in an hour.

However, as the dog was not suffering any heat injuries (I assume) the dog should not have been impounded or if it was it should have been returned with a citation not seizure of the animal. I have seen FAR WORSE cases of neglect go unpunished or handled with a warning by animal control. Since when do Americans allow the government to seize property because of what could have happened?

As for the 'they want to sell it' stuff, seriously now. They cannot 'sell' the dog until it has been vetted and neutered, neutering and shots cost, at just materials, about 150.00 for a dog that size. On top of this, paying for the court personel to fight to keep the dog cost another several hundred, housing, feeding, keeping the dog healthy, and so forth cost more.

Any dog, 50 lbs or more, that walks into a shelter and then walks out within 7 days has cost that shelter $200 or more in resources in most cases. Thats employee time, cage space, vaccinations, temperament testing, altering, and basic care.

Update oct 8

A once homeless Dauphin County man continued to fight Thursday, to get his dog back from the Harrisburg Area Humane Society.
It's a story CBS 21 News has been following for several months now. CBS 21 News was the only local television news station in federal court Thursday, as the judge made a final decision. 73 year old Miles Thomas will soon have his dog back.
" So glad, I'm finally getting Baron back. He means so much to me," said Miles Thomas, outside of the Federal Courthouse.
The collie was taken from Miles back in July. Court records show a Harrisburg Humane Society officer took the dog from Miles' car, while he ate lunch at Middletown restaurant. Miles was homeless at the time. Then the Humane Society released pictures of the day they took Baron, which they used to try and prove that Miles was an unfit owner. CBS 21 News caught up with the Humane Society's executive director, as she tried to avoid our cameras.
" I think it's going to be a great outcome involved for everyone. We're really pleased with it," said Amy Kaunas, Harrisburg Area Humane Society.
In the next few days, Miles Thomas, who now lives with a friend in Lewisberry, will get Baron back from the Harrisburg Humane Society.

For six months, an officer will check up on the dog. If Baron is well taken care of , the Humane Society can decide to give the dog back to Miles permanently. Miles has been allowed to see Baron only once, since July.

" I know when I went to see him, how he jumped up and kissed me. I know he misses me and we're going to celebrate, we truly are," said Thomas.
Some people, including Miles, did testify in Federal court Thursday. The judge made the final decision , after talking to both sides , who agreed to this resolution.
