34 Hour Restart

    Below is some tips & pictures of how to fill in the recap after you have completed the 34 hour restart. Drivers keep these few things in mind

    1. Make sure you take a full 34 hour break (or 36 if you might go to Canada). Do not take 33.75
    2. Make sure you do no work during this period. If you are busted with a fuel receipt, driving or loading/unloading etc. the restart is now considered no good and you could be running over your 70 hour.
    3. Make sure your log reflects the correct duty status while taking your 34 hour break.

    A. LINE 1: Means you are free to do what you want. Normally you are in the truck stop, casino, grandma's house etc.

    B Line 2: Means you are in the sleeper! Your body is in the sleeper.

    awww thank you, where did you get the frog? From the "More's??" I hardly click on that it takes forever to come up and then I have to do it every time.

    In the attachment it says a driver CAN bobtail for small errands and log it as "Off Duty". I asked my instructor about bobtailing off duty as long as the truck is not ladened and he said the driver MUST log it as "Driving". I’m unclear on this. Not only during the restart but even in general. Are you allowed to drive off duty bobtail IF you’re not working? I have a neighbor who will drop a trailer at his terminal and bobtail the approx 20 miles home and log it off duty.. his rig is NOT laden and he is NOT working. Is this legal? My trucking school (which is IITR in portland ore if it matters) says it is not... I can’t understand why an instructor would teach one thing if the law says another...

    Although I can't believe it took me 26 minutes to find the answer, I know it took a minute longer than expected.

    Please read below: Take this how you would like. You might let your trainer read this and bring it up to the company. However, I will say your 8,2 & 10 hour break must be at a stand still!
    DOT requirements on the 34 hour is simply you do no work! Going to the laundry matt, eating, shopping etc is not work. Now this get's tricky about going home. I do suggest making sure you have the available hours to drive home if bob tailing (not under dispatch) over say 30 miles. I just feel it could get really touchy legally if you killed someone as the rules do not state how far you can drive etc, then again on the flip side they just state you must not be laden or under dispatch. I tell my drivers to log it as driving because I don't want them in any ? if involved in an accident. That's usually after they have driven 11 hours and should be on a 10 hour break. That's when I have issue's!

    Question 26: If a driver is permitted to use a CMV for personal reasons, how must the driving time be recorded?

    Guidance: When a driver is relieved from work and all responsibility for performing work, time spent traveling from a driver's home to his/her terminal (normal work reporting location), or from a driver's terminal to his/her home, may be considered off-duty time. Similarly, time spent traveling short distances from a driver's en route lodgings (such as en route terminals or motels) to restaurants in the vicinity of such lodgings may be considered off-duty time. The type of conveyance used from the terminal to the driver's home, from the driver's home to the terminal, or to restaurants in the vicinity of en route lodgings would not alter the situation unless the vehicle is laden. A driver may not operate a laden CMV as a personal conveyance. The driver who uses a motor carrier's CMV for transportation home, and is subsequently called by the employing carrier and is then dispatched from home, would be on-duty from the time the driver leaves home.
