    I was actually asked to wear khaki pants and a wool sport coat to court.... instead of looking like "a cross between a Southern evangelist and a mafia hit man"...

    I explained that I didn't own any khaki pants, and didn't plan on buying any. And definitely not a sport coat.

    The analogy of the kid that darts out between two cars is somewhat flawed because shoul a driver be doing everything right doing speedlimit and obeying all other laws and the kid gets hit guess what. While I would not say something like "stupid kid" I would lean very heavily on the PARENTS and not at all on the driver. Now if an adult got mowed down for doing something stupid....I would just chop it up as his stupid action lead to the termination of his life.

    In either situation.... you the driver hit a person... and it likely could have been prevented. In this case, it was a buggy and horse(s), with people in the buggy... not a single person or kid darting in the street. They were there, they were marked, and they had a right to be there.... and it wasn't a surprise they were there, as it wuold be with a kid running after a ball.

    And it's "chalk it up", not "chop it up" - sorry, but misuse of a phrase like bothers me - chalk it up comes from making a mark on a chalkboard, a written record.

    Its clear to me that you are not aware of the fact that people of other cultures as well as different areas of the U.S say some things different ways. But hey....being that you know it all you most likely knew that.

    Heck down here the fools don't put out the triangle on their buggy. They say the colors are to worldly and the triangle represents the trinity. So instead they just get hit all the time. There is a big squabble now. They were told to display the triangle or stay off the road. They refused and a bunch of them got arrested. The DA ate their lunch in court. A very wise and noticeable attorney. Here is how he won the case. He watched them at break. They was out drinking coffee out of mickey D's cups in front of the court house. He asked them again why they would not use the triangles. When they got to the part about the worldly colors he stopped them. He said the cups you was drinking out of at break had the same color of orange in it.

    They were cited and fined. They refused to pay the fines and the county was nice to them. Instead of making them wear bright orange jump suits they ordered black ones just for them. Of course now the aclu or whatever the crap it's called is involved...

    Yes, I'm a know it all. Bummer for you. You'll be ok, though. Like my mom used to say, "you have the same clothes to get glad in that you got mad in".

    Well at the risk of greater censure from the twisted panties crowd I'll attempt an answer.


    Lets look at your examples.

    Blow over. Well since the first choice to a vehicle being blown over is a driver risking driving in high winds with what would apparently be a very light to empty trailer. I have driven relief supplies through hurricanes in Florida. Yes it does require the driver to make some judgement calls, but when you make a decision it is yours to deal with. So barring a immaculate conception of a tornado with no warning blow overs are on the driver.


    Narrow dirt roads. If you drive your truck into that situation(barring being a dump truck building a road or the like) yes that would be on you for driving there.

    Citrus haulers mechanical failures. Really need more information but I'll stick with the driver is ultimately responsible for inspecting his equipment. So again barring some undetectable ( I saw one where short of a spectrometer being used on a drag link the driver could not have known, and as such was exonerated in the deaths of three people) flaw yes the driver is at fault. No the trailer being left in the field since last season is not an excuse. No tank surge is not an excuse. No having the top auger come unlimbered is not an excuse. But again some more detail of what type of citrus hauler is needed for a specific answer.




    Out driving your headlights. Well regardless of what or why your sight is obstructed you are resonsible for stopping your vehicle. If you are running a road where the opportunity exists for a child to sneak up on the side of the road unobserved you should be crawling through that area. Now yes a tree falling on you that you failed to observe conditions where this might happen would shed some of the blame.As I posted earlier a heavy vehicle such as a class 8 truck should only be approaching the maximum speed limit in a very narrow set of circumstances. If any of those conditions are compromised it is the drivers job to adjust his speed where control can be maintained. Thhatis the hard fact that all the teeth nashing by the panty crowd fails to admit. You the driver are responsible for all of your decisions about operating your vehicle.


    That being a fact beyond contestation means that barring being struck by someone or something else you are at fault for any accident you are involved in. Now 8'm sure there will be a contrived fairy tale posted about the innocence of some poor driver verified by the US Marshals that will unequivically prove I'm a weak fraud office stooge incapable of driving a truck to the high level of failing to maintain control. Such is life I guess.
