Can I deduct??

    I live in Roswell nm. The company I work for is out of midland Texas, where I actually work is out of loving nm which is 95 miles away from my home. I had to get an RV to stay in because the cost of fuel would be to high back and forth every day plus I would not be able to get enough sleep for the next days work. I haul crude oil in a class A hazmat truck. Am I able to deduct my meals and lodging expenses?

    By lodging I mean the amount I pay to rent an RV space with water electric and sewage

    You can either deduct those expenses with proof of receipts OR take the daily per deim allowed by law.

    I always take the per deim.

    Truck drivers are allowed to write of 80 percent of 56$ per day. 56 was the rate, but that changes.

    Technically, NO. By having the RV at the location you work out of, you are returning each day to the same place you are dispatched out of. Per diem rules say you DO NOT return each day to the terminal you are dispatched out of, no matter where you actually live.

    I was under the impression that if I was gone 12 hours or more from my tax home I could do the 80% per diem.

    That's for travel or for a temporary job assignment... you're not traveling and your job is permanent. At best you can write off expenses for a short period of time to allow for relocation.
