Thanks for the replies. I am in a drug test consortium. My other driver is exempt as he doesn't have a CDL or drive anything over 26k.

Lawyers and police don't care about "I didn't have to test him legally" IF there is an accident or something and there happens to be something you didn't know about. I don't know this person. I am not accusing anyone of lying. Just good to be sure when it comes to your business. Good luck!
