I'm glad the subject came up on pretrip/postrip. The reg 395.2 says you would be on duty both times, if I read it correctly. Here's my issue I'm having and I would like some feedback with the exact reg(link).
The safety guy is telling me, no where in the reg it states that you have to log on duty time for it but you do have to flag it. Another person in the company who claims to have gone to DOT classes. Says it has to be logged 15 minutes for both, since you are on duty. I've been taught, you only needed to log one on duty and flag the other.
I've been inspected before and never had problems. What is the correct answer ? -
If your pre-trip takes longer than 7 minutes, you log 15. If you can do it in 7 or less, you can flag it. If you consistently flag pre-trips, post-trips and fuel, and your logs are looked at, it looks suspicious... so I don't recommend flagging everything, by any means.
I've always logged 15 at fuel, and 15 at pre- or post-... some companies want pre logged, some post. Company preference dictates. That said, many a DOT guy will say that the post trip is more critical, takes longer, etc and should be the one logged, not flagged.rookietrucker Thanks this. -

Agreed 100%. I'd do 15 on post trip regularly, then a couple times a week, log 15 on pre trip instead.
Getting two people ANYWHERE in the industry to agree on anything, well, I tell ya, it's like herding cats...

Wow, my head hurts now thinking about all these regulations, lawyers and lawsuits. I'm just starting a trucking buisness as an independant. TruckerDave thanks for your info. I found it most useful. When it comes to a lawyer in a civil lawsuit they can use small technicallitys to nail your butt on rediculous things. I guess thats the nature of the buisness we are in. Just hope your not involved in an accident. Also a thanks out to you other guys post, I see both sides. Lots of gray area on off-duty, on-duty time I'm discovering. I am afraid to think what uncle sam will have for us ten years from now.
