So one of our drivers was given a warning by some uninformed DOT inspector at the Kindersley scale yesterday for having more than 13 hours on duty in a day. We all know you can do 14 hours combined on duty and driving, 13 hrs max driving.
Do what's the deal on this?

In order to work a 16 hour shift you would have to log off duty two hours somewhere in the middle of the shift.

    Mandatory Off-duty Time (Section 13)

    53. What is meant by the term “work shift” and what is the maximum length of time of a work shift?

Guidance: Work shift means the elapsed time between two off-duty periods of at least 8

consecutive hours. Every off-duty period consisting of 8 consecutive hours or more resets the

work shift. The length of a work shift is determined by counting the time spent in all duty statuses

from the time you reported for work following an off-duty period of 8 consecutive hours or more

to the time you are released from work and take another off-duty period of 8 consecutive hours or

    more. Reference: Section 13.

    54. What conditions are imposed in the 16 hour work shift?

Guidance: No driver shall drive from the beginning of the work shift after accumulating:

    - 13 hours of driving time

    - 14 hours of on-duty time

    - 16 hours of elapsed time from start of the work shift.

A driver may drive if he/she takes at least 8 consecutive hours of off-duty time and obeys the

rules for daily driving (for example, 13 hours of driving time by day).

D.o.t at the slave lake scale told me that I cannot mark off duty when going to sit at a restaurant and eat because I am still responsible for my rig and therefore am still on duty. I said how am I supposed to log them 2 hours a day then if I'm always responsible for my rig?

He got a little upset and was adamant that he was right. I begged him to put it in writing so I could bring it to court but he wouldn't.
