Virginia allowed me to do it once. Lucky for me I adjusted correctly the first time and was allowed to "beat feet" outa there. That was a lesson that taught me to make sure I'm legal all the time no matter how bad I just want to make it back home

Depends on scenario, such as where you loaded and if it was possible to scale before you arrived, and the officer's mood.
I've been overweight without getting a ticket, but I literally loaded less than 5 miles away and was heading for a truck stop to scale. Just the officer's discretion...
If you passed places to scale out along the route, and decided not to, then they are not going to cut you any slack.

Because I loaded right by the weigh station, I wrote in an explanatory letter with my payment and Oregon issued a partial refund.
