OK expert amateur unlicensed truck stop lawyers who is at fault here?
    Background-
    broad daylight.
Swift team truck backing out backs into
reefer dude setting up behind them to back into another spot for himself.

Both parties believe it is the other party's fault. We need you to bang the gavel and assign fault.

My opinion, Swift was at fault.I mean, come on he must had seen the other truck in at least one mirror(I am assuming he was looking in mirrors).Wait a minute, you say that was a TEAM?!How come one of them didn't spot/stop traffic?!Swift at fault.

Whoever is backing is at fault. Just as if you hit anyone in the back you are at fault. Two golden rules.

It's always Swift's fault. Especially in this case.

I hereby sentence the trainer with 4 months experience to sit through a safety video, review the Smith System video, and 6 hours of time in the TV room at the Pilot. While parked in the fuel island.

dude backing out is wrong.......that's always the danger of nosing into a spot.......you gotta plan how you're gonna get out. And how in the heck you don't see a RED tractor in broad daylight is a mystery

You will be surprised at what you don't see Mr Opus.

Sometimes I think People will not be inclined to recognize the Second Coming should it happen in front of them...
