My husband and i went to OR on 07/04. We went on an unfamiliar route and ended up recieved the speeding for going 53 in 35. We didn't see the speed limit sign and it was posted as 55 in the previous area. We live in CA. My husband has a CDL for 5 years. He has a record of using a cell phone while he was driving,however,it doesn't show any point. We want to fight this ticket. We are expecting a baby girl in December and can't afford to have his license suspended,if something goes wrong again in next 3 years. My husband is,currently, unemployed, but, he tries his best to find a job. That serious violation will show on his record and cut the fortune of our family, if we don't fight the case.
Please help, or any suggestion. We would really appreciate that.

My husband also recieved non-moving violation ticket by using a cell phone on 01/18/09. Will that cause his CDL suspended, if we are not win in the court for the out of state speeding ticket?

You can hire an attorney (company) such as was suggested and they work. If the ticket was pre-hire they will still work for you but the fee is higher. The problem is not losing a license but CSA 2010. A non-moving violation with no points accessed is like a parking ticket. I assume it was in a big truck? If not it will not be recorded on CSA 2010 anyway. You should call the magistrates office that is on the ticket. OR. uses video cams and if a driver is polite a ticket can be reduced. I received one, called, the tape was reviewed and I got a non-moving reduction.
An over-the-road driver should have representation in the states ran. The implementation of 2010 and calls for safer highways--plus fed money for enforcement--means the possibility of more checks--thus more tickets--thus more points. Tell the hubby to get a head set for the phone, stop when using, or let the non-driver (logged accordingly) do the talking. BTW--TVC saved me once. CSA goes back 3 years on the driver and companies have access to the records. A "Notice of claim, Penalty, and settlement Agreement (a fine) can cost "thousands of dollars" and also flagged for increased roadside enforcement.-- (CSA 2010- J.J. Keller's driver's handbook: p. 7)
