Company withheld pay

    my husband is a driver in ND. He worked for a company that was known to have problems with the trucks, and a less than respected boss (foudn this out AFTER the fact). They lost their contract with a company out there so my husband in turn lost his position as well. They did not pay him for his work up until that point (14 loads). Calls to them have not been returned etc.

    What can we do now? Filing a wage complaint is not an option as he was an Independent. Can someone up there recommend an attorney? has anyone had this happen to them before there?

    no. he drove their vehicles.

    as i am reading more and more about this, i am wondering if he was classified incorrectly to begin with. Everything that he did was at their discretion

    A little late, but if you can't prove the loads he pulled, they can say he never did the work.
    If he drove their truck, went where they told him to go, and worked the hours they said he had to, he is an EMPLOYEE not a contractor. Illegal employment situation.
    State labor board will probably not help you and without any supporting paperwork to prove the work, a lawyer might be unable to help.
    Sad but true. Know the labor laws in the state you are employed.

    how do you know he has no paperwork. if he hauled 14 loads. he SHOULD have a copy of billing for each load.

    my bro in law keeps a copy so he keeps track of his payday.

    we HAVE paperwork. for each and every load he ever hauled.

    Call the North Dakota wage and claims office, here is the number. 701-250-4320. The office is located in Bismarck, I could be wrong. They can tell you what you can do to get your money.
