That's a tough one. You'd probably spend more on legal counsel than you'd get for your "pain & suffering". Let your Co take care of workman's comp. trying to get anything else would be darn near impossible, unless the 10 wheeler truck co had big pockets.

What's the company the other driver works for? Did he admit fault, and was he ticketed? What is the extent of your injuries? Were you taken to the hospital? Who do you work for, and who determined your injuries could be taken care of thru chiropractic therapy? I'm a licensed attorney who just made a career change into this industry. These questions are important and will be asked if you by any attorney, if any, you hire.

Sorry to hear about your trouble, and here's to a speedy recovery!

The answer is go talk to an attorney, and talk to a good one. The consult should be free.

Attorneys usually do this type of work on contingency basis (they get paid from the settlement if and when one is reached), and usually will not charge a fee for consultation, make an appointment with one to find out your options. But quite frankly, if you're able to work, I don't see much of a case.

You kinda sound like an old buddy of mine.
He got hit by a suv pulling a trl. It knocked out the tandems of his trl. He got shook up and then hired a we will sue anybody lawyer.
He was hoping for big bucks. I told him you got shook up nothing more. You can still drive right?
Walk and talk. Then you are what they call a nusinace lawsuit...
Crap happens, I got involved with a wreck, not my fault. They paid my down time and lost wages.
If your company has put you in a different trk. you are still working and fine.
Suck it up buttercup. Things happen and be lucky you did not get injured bad or die..

Don't go saying I'm scared to drive now and need counseling... I'm afraid to drive. Heck I had a trk. flip over on me. Took me a few days but I was back running again.

I'm not a big fan of trying to use accidents like you hit the lotto. However, if you do have real injuries, then the best course of action is to get a good lawyer. As noted above, consultations are free. Whenever I've needed to hire a lawyer I always used my dad's advise to "shop in three's": go visit three different lawyers for free consultations. Let them know you are shopping for a lawyer. Pick the one that you feel comfortable with that has good experience, a good track record, and with whom you can communicate well. I use that "shop in three's" strategy for everything from vendors to real estate agents and it's served me well. Along the way you also get free advise during the consultations.

If you walked away from the wreck. and that sounds like what you did do. then don't bother with trying to sue them. as long as you did your part in reporting what happened in the wreck. then the company you work for will take care of the medical needs. and the insurance company will pay for the damage to the eqiupment. at worst you were shaken up in the wreck or side swipe. no big deal. I feel worse for the motrists that were involved in the wreck caused by the strait truck.
