Pot smoking driver v drunk/drugs

    How is it that we have come this far marijuana laws yet were still enforcing ignorant out dated laws regarding testing?? I know of SEVERAL drivers that drink off duty and some that pop or snort pills on duty but they aren't penalized for there actions but if Jimmy smokes a bone on the tenth of the month and does a whiz quiz on the 20th he looses his job. Isn't there some other testing procedures that the feds could use that would be more accurate than what is currently being used? Is there a way to fight a positive whiz quiz if the detectable levels in the test are below a certain point? From all of the research and personal experience I have there is no possible way to accurately say Mr. X was smoking yesterday because everyone has different metabolism and processes THC differently. What does the legal experts here think of the testing procedures and chances of fighting a positive test?

    But seriously, I'm with you. We have Reagan and the "war on drugs" to thank. A great many people have been led to believe that all drugs are bad, always. If I could, I'd love to be able to burn one on a Saturday afternoon at my house. It's not gonna happen anytime soon though.

    Well, I am absolutely no.legal expert, but ANY amount that shows on a drug test is a failure. The feds have made the rules, and there is no room for discussion about it.

    You are correct. The laws are extremely outdated, but until those laws change, that is the law. Anyone that wishes to earn a living in this industry must follow the law or they seriously are risking the living that they earn.

    That's just the way it is, irregardless of anyone's personal belief.

    Here's an idea.... don't drink, smoke pot, do crack, whatever... if you want to drive a CMV.
    Hammer yourself with any of it all you want, but if there's a chance it will effect your thought processes or driving, leave the crap alone.

    PS, weed is not legal, not anywhere, period. It's a schedule 1 narcotic with "No known medical use"

    Do you seriously want advice on committing felonies AND endangering innocent lives??? Here it is...drop your truck now, turn your CDL in asap and proceed to nearest drug treatment facility. NO ONE can "beat" testing. Perhaps you've been too high to notice medical forensics let alone care about others lives while you were entrusted to. Do you even hear the selfish excuses you have stated?

    Sorry, Federal law trumps state law period. What is currently happening with marijuana is the Feds are selectively enforcing the laws as they do with everything else. There may be hope for the future of this topic but it is what it is.
