O/O won't pay me..

I finished my last trip for an o/o (leased on to Swift) on 10/18/09. I advised him of my resignation and offered to work another week as not to leave him high and dry. I returned the truck to the Mira Loma terminal where I got on it. I turned the keys over to dispatch.
I have over 2000 mi # 34 cpm and only received one Comdata deposit for $400 the following Fri.

He told me he was headed that way and would release the rest of the funds after the truck was inspected. He still hasn't returned my calls and apparently not looked at the truck. I told him I was almost broke and suggested he have the service dept at the terminal look at it.

After getting nowhere, I called Swift employee relations and all they could do was suggest I contact the labor board or small claims court.

Any suggestions on what I should do?

this is my sad experience with not being paid. We live in Missouri, and Missouri Labor Board does not care about the wages of a truck driver. We fall under Federal Laws, therefore they will not touch you.

We are owed the last 2 or so weeks wages by an outfit out of TN that is bankrupt.

1 week, 4500 miles or so by Infinity Transport, they have tractor trailers leased to Panther. Their reason for not paying, they put us through orientation and paid for the hotel room for a couple of nights. We quit when my husband got sick after a week. He died not long after that.

A company out of Texas God only knows how much. Their payroll was so screwed up, I don't know if we ever received every thing, but it took 2 months to get a last check.

A company out of Minnesota, where we averaged less than 25cents a mile, as a team, after it was all said and done, not what we signed on for.

And last but not least, the crooks out of Missouri, where hubby made 3300 dollars from 10-16-2000 to 12-23-2000.

No recourse other than small claims court in the State the company is.

I have never collected on ANY of this. Good luck to you.

Sabine, My condolences to you for the loss of your husband. After seeing what you & your husband have gone through, my problems don't seem so bad.

Guess I'll give this to the good Lord and follow His lead on what to do.

I appreciate it. We made some bad choices as far as some of the companies were concerned. All the research in the world is never going to tell you everything. It's all water under the bridge. Everyone of the heartless ba$tard$ will be getting theirs one day.

Do check in with the California Labor Board and the Wage and Hour division (they may be the same in Cali, I don't know). You never know, you may get somewhere with them. My experiences are specific to Missouri, and we all know that it is a little different out there in the land of the fruits and nuts.

And no matter what, a loss of money is always significant. It sucks not to be able to pay the bills because your employer needed your money more than you did.

I would not stop fighting this yet, as I said, you may be better protected than I am here in Missouri. I will keep my fingers crossed for you.
