| Mike ,DUI's don't vanish from your record unlike simple moving violations. Some courts do clear your record for first time offenders after a certain time but he or she would have known about this at court time.So if the court expunged the record,I can't see it showing up on a DMV report.USIS is a commercial operation.(DAC report)They are paid to do background checks by employers. If no past, present or future employer has not subscribed to their service nothing will show up.If in the future, you do apply to a company that uses a DAC report ,do make sure your DMV record is correct.DUI's hurt more than snake bites. |

| Let me see if I have this straight. USIS is the only file a trucking company would use to verify someones history. Previous employment history, driving record (nationwide) and background record are all contained in the USIS files. Is that correct? If I were to order my file from USIS and also request my criminal record info and MVR info, then I need not enter any info that is NOT listed in the USIS files on applications with trucking companies. Is that correct? If something is not listed in my USIS file, then for practical purposes, it does not exixt. Is that correct? Thanks.. |

Some thing that I have observed about the application process in trucking is that when they ask question's they say, did you EVER have a citation, Did you ever have this or did you ever have that. This way to broad and open ended. So many problems would be solved if schools would do the background investigation before a person spent there money on the training. The average person doesn't know whats on their record, and they don't know what will keep them from getting a driving job. Many don't know when something goes off their record. And what comes off your record, but is really hidden there somewhere. People don't know how much power companies have to get information. If a person can get a CDL then they have right to believe they can get a driving job. The government should do the background test. If a person gets a hazmat then they have a right to believe that they can get a job. The hazmat goes through the TAC for investigation. |

| If he got a DUI, it will be on his driving record regardless of the DAC report.

| I just downloaded a copy of my DMV record from my state ($12.00 fee for 10 year check)and the oui I had in 1989 doesnt show on it,but when i am filling out applications I allways check the yes box under dui or suspentions because "honesty is the best policy"and the little disclaimer at the bottom that says "falsification on this form could be grounds for dismissal'so I man up and admit it.Better to let em know upfront than to have them find out later and decide to dig into my personal life deeper and start splitting hairs and making it difficult on me and my family.

Do you know that companies get paid for information they give USIS. When you tell an employer about your dui they sell that information. The OOICO is fight this for truckers in court now. If you got a ticket when you were 16 is it fair to have it hanging on you for the rest of your life. Your a different person 10 yrs later. We learn and we grow. |

| There is no law dictating how far back someone checks your record. PLEASE UNDERSTAND THIS: Your record is permanent. It never goes away. Companies only retrieve your record 3-7 years back. If you know how far back they are looking - mostly 3 years - and you have a DUI or other tickets (older than 3 years) you are not required to cite them. You are required to tell them everything in the range of time they are searching for.
