It means you are contract or self employed.
-
The W-2 is the only correct way to be paid as a driver unless you are a leased owner. If you got a 1099 and question that it was the way it should have been paid, contact the IRS. The payment this way is for the employer to avoid the cost of an employee.Lilbit Thanks this. -
I'm just a driver they hold out nothing from my pay so i'm selfemployed? this could get messy not shur how to file employed and selfemployed at once

personally i hate being on a 1099, i've been taking out 25% of my pay each week and setting it aside, hope thats been enough...lol...also as an independent contractor i've been charged 2% each week out of my pay for cargo insurance... am i getting screwed?...is that legal?

You are not self employed. Contact the IRS. -
I discovered through IRS contact about 3 years ago, that if you sign a paper stating that it's ok for them to send you a 1099, or that you know you will be sent one it is legal. There is nothing you can do about it. My hubby had a boss pay him that way & I tried hard to fight it, but the IRS said since he signed a paper saying it was OK, to them it was. Do your research before signing. He made almost no money on this. -
Signing a piece of paper for an illegal way of employment does not relieve the law. Proper documentation and facts to the IRS will allow them to properly classify the employee. I would have suggested Problems Resoultion Office. There are 20 rules for what is an employee. I would suggest looking them up to see.
In the case of your husband, did he have any financial risk involved?
Was it a trucking job or something else?
I can forward the link to this if you wish.Last edited: Jan 31, 2009
