    State Tax

    I need some input on state witholding tax when you live in a state that doesn't have a state tax but work in one that does. I lve in FL, I work out of N Caralina, company claims they have to take out NC taxes. Several people have told me that's not true.. that I should be taxed by where I live( FL has no state tax). Thanks

    I too live in FL, work out of PA and don't pay any state taxes to PA. You are taxed according to your state, in our case we don't pay any.

    Thanks JB...I guess my company is misinformed or they just don't want to deal with NC. I wonder if I just contacted the federal tax people.. And if there is a way I could get back what I lost last year, about 1300... Not sure about this year yet.

    This happened to me years ago. What I had to do was file that particular states tax return and I got all the money back that was taken out.

    You need a Tax accountant, the can file to get your NC tax back.

    No you don't. You can go on that states website and download your forms. Also that state will send you their return to be filled out in the mail.

    Ask your employer or request from NC for the NC state only W-4 form, make sure you specify the the state form and not the federal W-4.
    Fill out the the NC W-4 as exempt, this will stop the company from taking out NC state tax, while not screwing with your fed taxes.
    I have done this several times with assorted states.

    Well..I talked to a lady at NC Dept of Revenue....she said state law "If you work or live in the state of NC you must have withholding taken out" she was also kinda pissy...like I had some nerve to eaven ask.I also contacted the feds and all they told me was that I could claim what NC kept as a deduction. I think I'm gettin screwed... We have an accounttant do our taxes and last year I questioned this , and he said that it was right. Maybe he just doesn't want to have to deal with tryin to argue with NC.

    Unfortunately, as a trucker, you do not work in NC.

    You can just file the return as a non resident in NC and get a full refund.

    I am surprised at your accountant.

    I too, am confused why this is allowed or legal. I am a Tennessee resident working for a Georgia based company and without my permission they are withholding GA state income tax. Yes, I can file now and get my withholding returned as a Non-resident employee, but how can it be legal for them to take my money (and earn interest off it) in the first place? I see the comment below about getting a state specific W-4 to file with the employer and I will look into that but it still begs the question, how much money is Georgia STEALING from truckers every year? Disgusting.
    (of course I use Turbo tax and they kindly offered for a fee of $38 to file my GA return to get my full refund of $24, LOL! (it was just one paycheck in 2010)
