Tax time!!!

Not sure if this in the correct sub-forum, but I have an important question about filing taxes and being in this business. I am a local/regional driver...meaning I am home pretty much every night. I am told by the employer that I still qualify for the daily per diem. A few CPAs I have talked to say that I can only claim the days that I was out overnight. Would someone one here be able to help me out with how this works? Thank you very much.

Anything that you buy for work or while working--such as food, boots, clothes, fuel to get you to work, etc. is what you can claim. But its smart to have receipts in case they come back to audit you.

I would not take the advice of your employer on this issue. The CPA's are advising you correctly.

The simplest way to look at it is if out overnight take a days per diem.

The technical formula based on the percentage of the day out is in pub 463.
