I've been in the same situation for about ten years now. When my ex split, my daughter was two, and she immediately filed for child support, and I mean within 3 days. She too spends almost all of it on herself and her boyfriendS. I fell behind for a while and had to play catch up. Nothing like making a big payment when you sell some property and the next time you pick your daughter up, you find a really nice big screen plasma hanging on her wall And then she has the nerve to ask for cash so she can go out! Anyway, I agree that you could set your own pay at somewhere near what you make now, that should work, but check with a GOOD attorney first. And btw, here in Ohio, the payments can go up, but they never go down, so if you go O/O and they up your payments, you could end up still having to make that payment even if it goes belly up on ya and you have to go back to co. driving. I'd check on that too. Good luck to ya!

Even if you reduce your net income,it won't work in your case.Although,Illinois has a minimum percentage deduction based on the number of children(1 child=20% of net)it also put in a safe guard for the children to receive a fixed dollar amount regardless of a reduction of your stated income ,you would still have to pay the courts predetermined amount.The only way you can change this is to petition the court for review.It would have to show good cause and those options are limited under Illinois law.If you feel that the money you are paying is not going to support for your daughter,petition the court,but don't start trying to scam the system.You may lose your job and may lose your CDL.Felonies and misdemeanors are included.

My husband and I had the same ex-wife you have--if he made a nickle more, she wanted seven cents of it. When we got serious about him becoming an O/O, I found a good accountant (it's not about knowing trucking, it's about knowing tax laws and numbers), and I talked to our pastor. I told them that I didn't want either of them or the IRS to be able to question anything we were doing. The accountant helped me incorporate, making me the president of the corporation with my husband being paid as a driver. He received minimum wage and I took a draw from the corporation. It ended up actually reducing the amount we were paying our ex-wife because he was making less than he had been working for some body else.
Also, if you are an S Corp, you get to deduct all of your expenses first, then you pay taxes on what's left; if you're self employed, you pay taxes on all of your income, then figure your deductions. There is more paperwork to being incorporated, but the benefits in a situation like yours can be priceless.

I am reading "Eddie Sachs - The Clown Prince" by Denny Miller. In 1955, Sacramento and Phoenix were the sites for the final two races of the Championship season. Eddie was reluctant to return to the West Coast because of marital problems with Betty. Bill Marvel remembers, "I heard that Betty had the authorities out looking for Eddie at Sacramento. He wasn't suppose to return to California because she had a warrant out against him. Sachs stopped on the back straightaway at Sacramento after the race and had someone pick him up and get him out of there because she had somebody after him."

If you are self employed you do not pay taxes on all your income. You get to take the deductions the same as an S-Corp.

I had a client that was in the same boat. We set the business up in her name. It was a self employment schedule c business. We made the husband an employee. The ex wife got an attorney and sued for a minimum amount from his pay. Therefore, paying minimum wage would not work. We did however control the amount paid to the minimum the decree called for. Anything else needed came out as a draw.
