Running the numbers I can hardly see where it even adds up to a stiff business expense. No wonder they just keep on doing it.

In 2004, Beam Brothers Trucking was fined $22,670 for 11 HOS violations. That equals a whopping $2, 060.90 per violation.

In 2010, Beam Brothers Trucking was fined $31,480 for 23 violations of "false reports of duty status" and 16 violations for "failure to preserve driver's records of duty status supporting documents for six months." Beam Brothers settled the charges and paid a $25,000 fine. Let's see, 39 violations, $25k fine equals $640.03 per violation.

I think they paid more a month or week in fuel. Pretty sad, that a driver can get fined more for using a cellphone, violating the HOS, or falsifying a log than the corporation that has hundreds of times more assets. If the FMSCA is serious about trying to stop this, then make the fines and penalties so severe it would rattle the nerves of Warren Buffet. Forcing or encouraging your employees to engage in illegal activity, will land the CEO, or top managers in prison, and the minimum fine would be in the double-digit millions of dollars, per violation. I wonder if they would think, aww, that's just a business expense....

How were the drivers "forced" to falsify their logs.
Did Beam hold a gun to their head or take a family member hostage?
Threaten to terminate their employment? 200,000 more jobs available immediately, so that excuse doesn't wash.
I just don't understand how a driver can say he was "forced" to commit a crime.

That's why I've always said driver abuse is self abuse . If you don't have the backbone to say no that's your fault .
But then you have the drivers getting $.26 a mile getting 1500 miles a week . If they have been parked for a couple of days they may be forced to take a run requiring 12 hours straight driving to keep from starving to death . I once heard a JB driver on the NY Turnpike trying to sell his CB because he hadn't eaten in 2 days and hadn't run the minimum required miles to get an advance .

eaton, i got a secret for you

it aint about safety or putting companies out of business, its about appearing to be tough on truck drivers, so they penalize the driver, NOT the large corporation

same thing with tax laws and other laws'

its the working man who gets screwed, those that are in power arent going to cannibalize on themselves when they have 300 million sheep they can eat
