In NY, that is an "affirmative defense". He can go to court and argue that, but the burden of proof is on him to show that he was legally transporting the firearm and ammunition from a place where he may lawfully possess and carry to another place where he may lawfully possess and carry. If the firearm & ammunition was readily accessible, he's up a creek. If the gun was loaded, he's up a creek. If he was picking up or delivering in NY, he's up a creek. I don't know too many specifics in this case, but I'm thinking he wishes he had a paddle right about now.

 

will be interesting to see if this becomes NY's "heller vs DC" or "McDonald VS Chicago"....

 

ya do know there's a loop to that right? the way it's written puts judgment into the hands of the officer, especially in NY, because i know Fl's CCP isn't any good there. But either way they have him, for the simple fact he had a 10rd mag with all 10rd's in it.

 

I never realized upstate NY was such a dangerous place...

 

Some places are dangerous , Rome NY for instance nice place until the sun goes down.

 

i think that was just another paranoid driver...

 

Park in Rome at night and the cops knock on your door , not to tell you not to park there but to show you a SECURE area that they patrol so its safer.
