manditory 30 minute break goes into effect july 1st 2013 ...or so im told

    Wrong. As of Feb 2012 ANY time spent in a parked CMV can be logged on Line 1. Even if parked in a loading dock.

    1. *A. Definition of On-Duty Time
    2. The FMCSA is excluding from the definition of on-duty time (i) any time resting in a parked vehicle, or (ii) up to 2 hours in the passenger seat of a moving property-carrying CMV, immediately before or after 8 consecutive hours in the sleeper berth.

    Rules were made to be broken. If you are not allowed or requested to be on the dock, you are (I am) off duty irregardless of what is going on in the truck. I don't give a damnn how the book reads. Throw the cuffs on me and pattyj.

    But the 30 minute requirement is going to create new parking problems we have not yet began to comprehend yet. Plus, some "truckers" you don't want backing into a tight spot any more than absolutely necessary, and for some, this rule will require a back they may not have otherwise done. Good luck. I'm glad I got out when I did.

    As for line 3 many carriers have it noted in the employee handbook under what conditions a driver may go off duty . If you are free to leave the truck and go to a break room or across the street to a store or restaurant you can log off duty .

    Ok Ill ask it again? How many of you would work at a job and if the boss told you you had to work for 8+hours straight--WITHOUT a break of any kind?

    I take a break. I log a fuel stop in the middle of the day, grab a sandwich and a soda and roll, and stop 10 minutes for a pee break later. That's all I need. I'm sorry you need a "30 minute break" but that's your problem, not mine. A fifteen minute break works for me and I don't have to park. And, I get to my end-of-day that much sooner. Some of us don't see the need to waste time and trash around every single day IN THE MIDDLE OF A WORKDAY longer than we're already forced to with prescribed fuel stops. Your assertion I am making myself a "slave to the man" by not needing or wanting to waste 30 minutes of MY DAY at some odd location is both ridiculous and misguided. It's mindsets like yours who has brought us the ridiculous regulations we all live with in every facet of work. You should get a union job if that's the way you feel.

    Perhaps this 30 minute break should have been made optional, at the DRIVER'S discretion. That way those that prefer not to take a break would have that option, but if a company retaliated against a driver for taking that discretionary 30 minute break, the feds would come down on the company HARD.

    Was there a study done that shows that taking a 30 minute break during the first 8 hours of the work day reduces crash risk? I'd be curious to know that.
