On Monday, Walmart delivered its answer in a New Jersey federal court to 30 Rock actor Tracy Morgan's lawsuit arising from a six-car accidenton the New Jersey turnpike. Among nine affirmative defenses, Walmart says that injuries "were caused, in whole or in part, by plaintiffs' failure to properly wear an appropriate available seatbelt restraint device."

In particular, their lawsuit filed in Julyquestions whether Walmart driver Kevin Roper was fatigued at the time of the crash. According to the suit, Roper had commuted 700 miles from his home in Jonesboro, Ga., to a Walmart facility in Smyrna, Del., before beginning his shift.

Sounds like an appropriate affirmative defense to me.... All they are saying is that there was contributing negligence on the part of the plaintiffs, and, just like Wal-Mart doesn't deny that their driver caused the accident, it's going to be hard for the plaintiffs to deny that they would probably have been better off had they been properly restrained.

A driver in a truck going 20 mph over the posted speed limit and slamming into the back of the said limo wouldn't have caused any of this..... Poor Walmart. It's the liberal media lying again!!!! Waiting for that response....

As I said is that to my knowledge Wal-Mart has not denied that their driver caused the crash. They are accepting responsibility. That doesn't mean that Tracy Morgan or any other victim in that crash is suddenly going to become the majority shareholder in Wal-Mart, nor should it. All they are doing is what any prudent business would do, and that is to try and protect themselves and their shareholders to the greatest extent possible. I could be wrong, but my surmise is that's exactly what you and your insurance company would do if, God forbid, you should ever find yourself at fault in an accident.
